Es una "bonita" muestra de lo complejos que pueden llegar a ser los comportamientos en las aulas. Digo bonita entrecomillado porque se me ponen los pelos de punta al pensar en cómo lo deben de estar pasando miles y miles de criaturas, acorraladas e incomprendidas por sus compañeros y profesores.

Salud Segarra Juan educa a su hija Lola Márquez Segarra, de 7 años de edad en casa, consideramos que esta acción es ajustada a los derechos constitucionales y legales en España. No existe prohibición expresa alguna en ningún texto legal que impida educar en casa, como no existe tampoco esta prohibición en los diferentes convenios internacionales firmados por España, siendo por el contrario éste un derecho reconocido por la Organización de Las Naciones Unidas (ONU).
Entendemos que la actuación de Salud Segarra Juan es una actuación consciente y que, conocedora de sus deberes y derechos, ha asumido plenamente la responsabilidad de educar en el hogar, amparándose en la Constitución española, artículo 27.1 y artículo 27.3. Estos artículos reconocen la libertad de enseñanza y el derecho que tienen los padres de escoger en qué forma quieren educar a sus hijos.
Los tribunales, cuando han tenido oportunidad, han considerado que el derecho a la educación no se protege y garantiza únicamente a través de la escolarización y de la integración del alumno en el sistema educativo que diseña la Ley, sino que "la formación educativa, efectuada al margen de la enseñanza oficial, es perfectamente aceptable en el marco de libertades diseñado por la Constitución".
Hay sentencias favorables en este sentido pero sería largo enumerar; sin embargo sí queremos destacar que ya en lugares como el País Vasco, Andalucía o Cataluña, entre otras, existe jurisprudencia al respecto reconociendo la legalidad y viabilidad de esta opción legítima y creciente no sólo en Europa y en el mundo en general, sino también en España.
Dicho esto queremos reiterar que consideramos que este no es un caso de falta de responsabilidad por parte de los padres, ni de negligencia, ni tampoco de absentismo escolar, más bien al contrario, se podría calificar de un exceso de celo por ofrecer la mejor formación posible respetuosa con el niño y coherente con los valores de su familia, valores inscritos dentro de los valores democráticos del Estado español, y por lo tanto plenamente respetables.
Sirva pues el presente para mostrar nuestro apoyo a la familia y la manifestación de que compartimos plenamente los mismos sentimientos que animan a los padres a educar a sus hijos en casa.

Quizás pensaréis que éste año mi lista es larga pero me conformaré con sólo sentirme escuchada.

Deseo:

Que me escuchen para aprender a escuchar y así poder comprender a los y las demás

No sentirme tan cuestionada ni juzgada pues, a menudo, creo lo que dicen de mí y me genera inseguridad

Que los miedos y prejuicios de los adultos no me nieguen oportunidades

Que los condicionantes educacionales y sociales no ahoguen mi espontaneidad

Poder dejar volar mis sueños y despertar así mi creatividad

Que se me tenga más en cuenta para decidir que debo aprender y mi motivación se multiplicará

En un tiempo en que la Escuela se universaliza sobre el cadáver de las distintas modalidades educativas no-occidentales, en que reduce a la mínima expresión las restantes instancias de transmisión cultural, con las que de algún modo competía, en que se sabe sin enemigo, sin paliativo, sin contrarresto, ídolo sin crepúsculo, autoridad incuestionable, la figura de Iván Illich cobra una importancia inusitada.
Así como contamos con una robusta tradición pedagógica, un amplio abanico de experiencias reparadoras de la escolarización, que se despliega desde las Escuelas Nuevas de la primera hora (vinculadas al reformismo originario de Pestalozzi, Dewey, Montessori, Decroly, Ferrière...) hasta las Escuelas Libres de hoy mismo (con Summerhill en Gran Bretaña, Paideia en España y Pesta en Ecuador como proyectos señeros), pasando por el “progresismo” de las Escuelas Activas (Freinet, bajo la pancarta), de la llamada “Pedagogía Institucional” (Oury, Vásquez, Lobrot) y de las propuestas “no-directivas” (Rogers), etc.; así como son miles los autores que han pensado para la Escuela, viendo el modo de “mejorarla”, “reformarla”, “modernizarla”, “actualizarla”,... apenas podemos citar a unos cuantos teóricos “disidentes”, entregados a la crítica “radical” de la institución de enseñanza, en la línea de lo que se ha titulado “anti-pedagogía” o “desescolarización”.

ASOCIARSE PARA DEFENDER EL DERECHO A APRENDER EN FAMILIA

Resumen: La asociación para la Libre Educación, ALE, agrupa a varios cientos de familias que educan a sus hijos en el hogar. La asociación es plural y no está vinculada a ningún movimiento político, confesional o pedagógico. Algunas de las actividades de la asociación son la creación de redes de apoyo, la recopilación de información legal, el asesoramiento a familias, la difusión y el contacto con otros grupos afines, dentro y fuera del estado español.

Abstract: The Association for Freedom of Education, ALE, brings together hundreds of families who educate their children at home. The association is diverse and is not bound to any political, confessional or pedagocical movement. The activities of the association include the creation of support networks, the compilation of legal information, advice to families, media broadcasting as well as contact with other like-minded groups, both within and outside of Spain.

Desarrollo:
a) Objetivos:

Creemos que los niños tienen derecho a aprender en familia.

Consideramos que todo aquel que elija esta opción para sus hijos no debería ser discriminado por la sociedad ni perseguido como un delincuente.

Queremos que se reconozca la libertad de elección de la forma y lugar en que nuestros hijos aprenden.

Sabemos que es un camino difícil y pensamos que es mejor no hacerlo solos. Somos una minoría y nos conviene estar bien comunicados. Cualquier acción emprendida nos afecta a todos.
Podemos trabajar juntos, asociarnos y estar en contacto.

b) Descripción del trabajo:

Asociación para la Libre Educación

La Asociación para la libre educación, ALE, agrupa a unos cientos de familias procedentes de todos los puntos de la geografía española , cuyos hijos no acuden a la escuela. Estas familias han optado por el llamado homeschooling, es decir, que han asumido la responsabilidad de educar a sus hijos en el hogar y, debido a la falta de reconocimiento legal y a que se trata de una opción minoritaria, sienten la necesidad de asociarse para tener un apoyo en su experiencia y para buscar juntos dicho reconocimiento formal.

Se trata de familias con distintos motivos para educar en casa, distintas maneras de vivir y de educar y distintas opiniones respecto a la forma de buscar el reconocimiento legal de nuestra opción. Y ALE, como entidad, tiene como razón de ser, actuar en favor de las familias que educan o que quieren educar en casa, y eso, en temas de legalidad y dada la pluralidad de sus componentes, es algo complejo y no tiene respuestas fáciles.

La Asociación para la Libre Educación ha puesto este año en marcha un modelo abierto de participación asociativa que, buscando la confluencia de la gran diversidad de los socios y buscando apoyos en asociaciones homeschoolers nacionales e internacionales, ha propiciado un rico diálogo donde todos, incluidos quienes no están asociados, nos podemos encontrar y aportar los unos a los otros en busca de un camino común.

Dónde estamos

A veces toca empezar de nuevo. A la ALE, la asociación para la defensa de la libre educación, le ha tocado este año de 2011. Partiendo de los impagables esfuerzos de quienes vinieron antes, de sus logros y avances, de los espacios que conquistaron para nosotros en esta sociedad, nos toca ahora asumir el riesgo de equivocarnos, y abrir nuevas sendas, generar nuevas sinergias para re-inventarnos y conseguir que nos permitan a todos y todas, adultos y menores, educarnos libremente, respetuosamente, siguiendo aquellos criterios que, en conciencia, consideramos los correctos y deseables. A veces toca empezar de nuevo porque las circunstancias así lo exigen, con nuevos movimientos e iniciativas.

Este año, a una nueva Junta Directiva se le encomendó empezar de nuevo y se reinventó a sí misma, descentralizándose de algún modo, al abrirse a la participación de cualquiera en ella como vocal. De este modo, junto al nuevo presidente, vicepresidenta, secretaria y tesorera, más de cuarenta vocales completan la junta directiva. Esto no es ningún obstáculo para que otros socios, que no son miembros de la junta directiva, estén colaborando muy activamente en diversos ámbitos y se invita a todo el que lo desee, a que escriba en el blog (con la campaña 31 días, 31 escritores), trabaje en el equipo legal, el de prensa o el informático, de respuesta a las consultas realizadas a la asociación, organice encuentros en sus comunidades autónomas, etc. Y parece que ha habido una respuesta a la llamada a la participación activa de los socios, en la defensa de nuestro derecho a asumir, hasta el final, la responsabilidad que, como progenitores, tenemos de ofrecer a nuestros hijos e hijas el mejor aprendizaje que merecen.

Partimos de una premisa: constituimos una gran pluralidad, y nos reconocemos en ella. Es muy importante que todos nos sintamos respetados y representados, porque ALE somos, precisamente, esa sinergia que nos reúne a personas con muy diferentes estilos de vida, convicciones, credos, aspiraciones, formas de educar y que, sin embargo, se reconocen como iguales en el derecho a la libertad de que sus hijos aprendan fuera de la escuela oficial, en familia, en sociedad y en comunidad. Tenemos que aprovechar esta insólita confluencia de diversidad respetuosa de sí misma, en busca de un objetivo común: la libertad educativa.

Ser o no ser.... regulados

¿Cómo se puede sostener esta pluralidad en asuntos que muchos ven como algo blanco o negro? ¿Cómo se puede tener en cuenta, a la vez, los intereses de un grupo de personas que de un lado piensan que es mejor tener una regulación explicita para no sufrir futuros o presentes problemas legales, y de otro que una regulación ahora traería a nuestro entorno algunos de los mismos problemas, o quizá mayores, por los que no elegimos la escuela convencional?

Para intentar tratar de resolver esta contradicción, hemos apostado por el diálogo, pensando que, con un proceso de comunicación abierto y respetuoso, pueden, finalmente, verse cosas que no eran antes visibles. Con este fin, hemos organizado unos encuentros con el nombre de Reuniones Locales Sin Escuela, por toda España, abiertas a todo el mundo que educa fuera del sistema oficial, ya fueran miembros de ALE o no y educando en casa o en escuelas libres, con el fin de tener la mejor visión global de nuestra situación. Continúa, pues, la llamada a la participación activa, inclusiva. También esta vez ha habido respuesta, y en numerosas provincias se han producido ya encuentros que han servido para afianzar lazos de proximidad y reconocimiento, discutiendo abiertamente los aspectos fundamentales de nuestra situación actual, y coordinándose entre ellas, para encontrar puntos de encuentro.

En estas múltiples reuniones se ha hablado de cómo solucionar los problemas a los que se enfrentan las familias cuando sacan a los niños del colegio, de cómo afrontar la discriminación a la hora de obtener títulos, de la difusión y aparición en medios de comunicación, etc. y ha vuelto a plantearse el debate sobre la regulación: lograr el reconocimiento legislativo explícito, contactando con las autoridades y aceptando una regulación, posiblemente más restrictiva de lo deseado, con el fin de solventar la incertidumbre actual o concentrarnos en pelear como colectivo para ganar los juicios que se van produciendo y ofreciéndonos apoyo mutuo, a la espera de una sociedad más preparada para aceptar nuestro ejercicio de libertad. Se ha podido hablar libremente sobre los pareceres e inquietudes de cada cual sobre las posibles líneas de actuación. Y seguimos comunicados a través de un grupo de correos abierto a todos los que quieran participar. Estos debates continúan aún, esperando que el esfuerzo de intentar encontrar un camino, que respete los deseos de todos, tenga sus frutos.

Las líneas de actuación han sido varias en los últimos años por parte de ALE. Volvamos atrás los pasos. La asociación se gestó, hace unos nueve años, a partir del antiguo grupo, de ámbito estatal, Crecer Sin Escuela1, que basaba su comunicación en un boletín de periodicidad trimestral a domicilio. En 2001, se creó una lista de correo electrónico con ese mismo nombre, pero acabó cambiándose por el de Educación Libre2. Esta lista todavía esta activa, y fue el lugar donde nació la idea de fundar una asociación formal en busca del reconocimiento.

En diciembre del 2002, las personas que estaban más dispuestas a plantearse la posibilidad de negociaciones con la administración y a debatir sobre las posibles concesiones que se pudieran ofrecer a cambio de acceso a exámenes libres o de entrar en un marco legal claro y definido, fundaron la Asociación para la Libre Educación, ALE3, que en sus estatutos expresa los objetivos de defender el derecho de las familias a educar a sus hijos en el propio hogar, facilitar la información de esta opción educativa a todos aquellos que se interesen por ella, crear redes de apoyo entre las familias que eduquen a sus hijos en casa, reclamar el reconocimiento legal, exigir el libre acceso a los exámenes para la consecución de títulos oficiales sin discriminación por edad, procurar un intercambio enriquecedor entre la educación en el hogar y las instituciones educativas y mantener contacto con otros grupos afines, dentro y fuera del estado español. Además, la asociación se declara no vinculada a ningún tipo de movimiento político, confesional o pedagógico.

En los comienzos de ALE, se quería llegar a un reconocimiento por parte de la sociedad en que vivimos. Hubo contactos con la administración, y se continuó con la difusión que emprendió Crecer Sin Escuela, pero con una actitud más favorable al reconocimiento que aquella. Pero sigue sin llegarse a un acuerdo sobre si se debería emprender el camino de la negociación con la administración. En 2006 se produjo una ruptura en la asociación, y varias familias salieron para formar Educar En Familia, Coordinadora Catalana pel Reconeixement i la Regulació de l’Educació en Família4, una organización totalmente a favor de la negociación para conseguir una regularización del homeschooling, mientras que en ALE había serias dudas sobre el tipo de regulación que podía darse en el clima imperante y el enfoque continuó centrándose en sus otros objetivos.

Se optó por poner quejas al defensor del pueblo español y figuras equivalentes de las comunidades autónomas, para conseguir apoyo y se tuvo éxito en distintos casos. También se fue estableciendo contacto con diferentes representantes administrativos y políticos de nuestro país, acercando nuestra propuesta y exponiendo la necesidad de un cambio en la LOE y en los protocolos de absentismo.

Al mismo tiempo, se continuó con una labor de compilación de los distintos archivos legales de los casos ganados para que cada familia pudiera tener acceso a ellos, y servir de apoyo a las familias que atravesaban procesos legales, a través de contactos con abogados, cartas de apoyo, informes pedagógicos e ideas para las estrategias a seguir. La asociación ha venido realizando un trabajo de asesoramiento y acompañamiento a estas familias, que necesitan apoyo en esos momentos.

Además, se dispuso de un foro de uso exclusivo para socios donde todas las familias pueden leer e intercambiar contenidos sobre el aprendizaje en casa y sentirse apoyados y en contacto con otras familias en la misma situación. Y, desde los comienzos, respondiendo a la necesidad de las familias socias de establecer lazos presenciales tanto entre los padres como entre los niños, anualmente ALE organiza un encuentro en verano, de carácter estatal, además de haberse creado grupos en diferentes zonas que realizan encuentros durante todo el año.

Por último, se ha hecho énfasis en la difusión, saliendo en prensa, radio y televisión, publicando dos libros, manteniendo una página web y un blog, estando presente en las nuevas redes sociales de Internet, atendiendo un número de teléfono y dirección de correo electrónico de contacto para padres con dudas y participando en charlas, conferencias y ferias por todo el país, con el fin de dar a conocer el homeschooling e influir en la opinión pública para que pueda ser aceptado con más facilidad.

Sinergias

Ahora toca empezar de nuevo, y ha sido clara la llamada a la implicación de las familias para lograr entre todos, no ya sólo fortalecer y ampliar una red de apoyo mutuo, sino para comprender y debatir nuestras diferentes posturas en busca de caminos comunes para tratar con la administración, y para comprender nuestra opción común en su integridad y diversidad. Las sinergias que han producido las respuestas a este llamado, han dado ya sus frutos y diversos proyectos han echado a andar.

El encuentro anual de Ale al final de éste verano se convirtió en un peculiar evento donde se sucedían y simultaneaban charlas, discusiones, talleres, cuenta-cuentos, encuentros, una interesante confluencia de diversidad. Y este escenario fue el marco de una Conferencia internacional sobre homeschooling, en la que participaron representantes de las principales asociaciones europeas de diez países europeos: Reino Unido, Francia, Italia, Bulgaria, Países Bajos, Portugal, Suecia, Alemania, Polonia, España y con una representación de la HSLDA de los Estados Unidos.

Se dialogó sobre las mejores maneras de ayudarnos mutuamente, y resultó muy interesante aprender de los diferentes procesos de cada país y ver cómo podríamos aplicar algunas ideas y estrategias a nuestra situación aquí, en España. Los vídeos de las ponencias de la conferencia se pueden encontrar en nuestro Blog5 o en nuestro canal de video6. Las conversaciones han continuado desde entonces y hay una conferencia, a través de la web, planeada para diciembre y otra reunión en Alemania, en Enero, para seguir trabajando en la forma de aunar esfuerzos y sumar fuerzas. Pensamos que es importante mantener, y aún ampliar, esta unión porque nos enfrentamos a estructuras similares y podemos beneficiarnos los unos de los otros trabajando en común.

A este encuentro asistieron más de cuatrocientas personas, entre adultos y niños. Se invitaron a representantes de otras asociaciones españolas, relacionadas con el aprendizaje fuera de la escuela y se recuperó el diálogo sobre la búsqueda de la regulación, lográndose un ambiente de respeto y confianza entre todos.

Continúan, pues, extendiéndose las sinergias, lo diverso sigue confluyendo para lograr encontrar caminos, nuevas perspectivas. De estos encuentros, que la llamada a la participación y la implicación ha proporcionado, se han formado además diversos grupos de trabajo, que plantean abordar la situación desde los ámbitos legales, sociales, psicológicos, educativos. Se está contactando a diversos profesionales de los distintos sectores, para propiciar su encuentro y discutir los diferentes aspectos de la opción de educar fuera de la escuela o en casa. Estamos organizando una video-conferencia con abogados y profesores de derecho para Noviembre y queremos hacer lo mismo con sociólogos, psicólogos, educadores, etc. así como realizar contactos con la comunidad académica, sensibilizada con esta opción educativa, y otras asociaciones u organizaciones con intereses comunes.
Paso a paso, pero sin pausa, se avanza en los distintos ámbitos y la idea sería poder disponer finalmente de un dossier, abierto, siempre ampliable, que estuviese a nuestra disposición y pudiera valernos en nuestra defensa, en caso de que necesitáramos defendernos.

Resultados y/o Conclusiones:

Hay que empezar de nuevo, y hemos empezado por reencontrarnos. Ahora buscamos la mejor manera de caminar juntos ayudándonos, aportando cada cual aquello que puede aportar, que siempre es mucho por poco que pudiera parecer. Somos diversos y aceptamos nuestra diversidad. Queremos, de hecho, disfrutar nuestra diversidad en libertad. Y aquí es, quizás, dónde radica el problema, ya que con nuestra opción, nos enfrentamos todos a grandes temas: desde la relación entre el estado y la familia, entre la sociedad y el ciudadano, a la aceptación por parte de las autoridades y los ciudadanos de a pie de opciones educativas divergentes de las actualmente vigentes.

Nosotros quisiéramos que todo el que esté interesado se anime a formar parte de nuestra asociación7. Por una parte, las familias que quieren educar fuera del sistema educativo oficial, independientemente de que estas pertenezcan, a su vez, a otra organización. Todas podrían tener un lugar en ALE, por la libertad de educación y por nuestros hijos, que es lo que a todos nos importa. Y por otra parte, aquellos profesionales y académicos que crean en el derecho a educar y a aprender en familia, también tienen cabida en la asociación. De cualquier modo, respetando la libertad de cada uno, de querer asociarse o no, queremos establecer vínculos con todos ellos porque creemos que todos juntos podemos ser más fuertes, que la visión de cada uno es valiosa y que así las mejores ideas podrán llegar a la práctica.

La tribu homeschooler

Para la mayoría de familias que educamos fuera de la escuela es muy importante hacer comunidad.

Es importante para las madres y padres, porque compartimos inquietudes, experiencias y reflexiones que no nos pueden aportar otras personas que no vivan esta opción educativa. Muchas veces, fuera de esta tribu, nos sentimos cuestionados, juzgados o curioseados y, aunque, por suerte, no siempre sea así, sentimos la necesidad de encontrar más familias que vivan nuestras mismas circunstancias.

También es importante para las niñas y niños. Es muy agradable comprobar que hay más niños que no van a la escuela y que, normalmente, tienen un juego más similar al suyo. Ellos también comparten inquietudes, aprendizajes y experiencias.

La tribu homeschooler es muy amplia; los que tenemos suerte, nos encontramos con unos amigos varias veces a la semana, con otros una vez al mes y, con otros alguna vez al año; aunque solemos mantener contacto virtual con todos ellos y, así, los tenemos "a mano" casi en cualquier momento.

¿Donde creamos tribu? ¿Por donde empezamos a buscar esta comunidad?

En mi caso (y en el de otras familias que conozco), la aventura empieza en el grupo de lactancia y crianza... Noralmente, las familias que optan por educar fuera de la escuela, se han preocupado primero por ofrecer una crianza de apego y respetuosa.

El grupo se va ampliando gracias a los medios virtuales: foros y blogs. Amigas y amigos virtuales a los que luego te alegra mucho poder ponerles cara y voz.

Otra forma de crear comunidad es a través de asociaciones como ALE, que propicia encuentros estatales anuales para este fin.

Los socios de ALE también disponen de un foro privado, en el que es fácil encontrar gente mas cercana geográficamente y, así, poder realizar encuentros más frecuentes.

Luego, claro esta, aparecen los amigos de los amigos y la red se hace cada vez más rica y variada.

Al final, resulta que casi todo el mundo se conoce... Algunos dicen que es porque somos muy pocos; a mi me gusta pensar que es porque somos muy sociables :)

Espero que algún día forméis parte de esta tribu, si es que no formáis parte ya ;)

Quién da problemas a quién?

Reconozco que con él he sentido un escalofrío.
No se tiene ningún pudor en reconocer que los problemas en las aulas no han bajado a pesar de las medidas "policiales" y de autoridad implantadas pero que eso da igual, porque según se comenta, lo realmente importante es que ya no figuran en la estadística.

Por supuesto que nadie piense que estoy a favor de que los padres acosen, insulten o amenacen a los profesores. Lo que me inquieta es la actitud que se dibuja en los responsables de educación, y que queda bien de manifiesto en párrafos como:

El gran reto que tenemos ahora, no sólo nosotros, sino toda la sociedad, es arreglar el divorcio entre algunas familias y la escuela", señala la vicepresidenta de Anpe. Inmaculada Suárez, la Defensora del Profesor, explica que hay muchos padres que no reconocen que el especialista en pedagogía es el profesor y que, si hay 28 alumnos en el aula, no puede haber 28 modelos pedagógicos distintos". "Los padres tienen que entender que la libertad de su hijo acaba donde empieza la del resto de compañeros".

Más triste aún es darse un paseo por los comentarios de los lectores, en los que abundan las quejas y petición de sanciones y multas ejemplares para aquellos padres que osen opinar en contra de la "autoridad del especialista en pedagogía".

Hola a a todos:
Soy la segunda hermana de cuatro y cada uno hemos sido totalmente diferente en nuestra manera de aprender. Mi hermano era un niño que le gustaba desde muy pequeño desarmar todo lo que pillaba, yo le ayudaba, esto me enseñó mucho. Al principio lo rompía a golpes, muchas veces yo buscaba una gran piedra roma para poder destrozarlo adecuadamente (había que romper el exterior pero no el interior), y así ver cómo era por dentro, después fue depurando su técnica, a él le gustaba ver el interior y explicármelo, a mí me encantaba todo este proceso, y por supuesto participaba, después nos pasábamos horas intentando armar de nuevo el juguete roto o el reloj; más tarde empezó a hacer croquis según lo desmontaba para después montarlo…Ni que decir que entre los dos podíamos armar y desarmar lo que nos diera la gana. A los 15 años arreglábamos un brasero o una lavadora, a mi me fallaban las fuerzas…pero como equipo no teníamos desperdicio.

Todo esto lo he contado porque esta forma de aprender no era la normal en nuestro tiempo, y aunque en casa jamás nos riñeron sabíamos que en el colegio había que memorizar sin comprender, para mí era imposible, yo tenía que comprender para poder aprender, era inútil memorizar.

Sin embargo la siguiente en la familia, era memoria, aprobaba sin comprender, a no ser que preguntará y comprendiera lo que la decíamos, recuerdo un día estaba en 5º de EGB que muy enfadada delante de un mapa de la península Iberíca, le daba vueltas y vueltas, por fin gritó: ¿Pero dónde está España? A ella había que decírselo todo, marcarselo y que mirará, necesitaba una guía, hoy cocina con manual en mano, todo es perfecto…lo controla todo. Y en su trabajo es muy querida por lo bien estructurada que es.

La siguiente en la familia, era completamente distinta a los tres, más independiente, más solitaria, cuando necesitaba algo siempre sabía a dónde tenía que llamar para conseguir lo que quería o necesitaba.

Cada niño eramos un mundo dentro de una misma familia y donde todos teníamos las mismas cosas y compartíamos casi todo.

Evidentemente nuestra personalidad marcaba nuestra forma de aprender. Tenemos una disposición para aprender de una manera determinada y que esto se hace a partir de la socialización. Yo estaba siempre con mi hermano, y esto hizo que aprendiera mucho con él. Mi hermano imitaba a mi padre. Sin embargo mi hermana la número 3 imitaba más a mi madre, y aprendía más de ella. La 4º al ser la más pequeña, con diferencia de edad entre los tres mayores, se lleva 8 años de la 3ª y por esta situación estuvo más sola en sus juegos y esto marcó su forma de socializarse y de aprender. Por lo que estoy de acuerdo totalmente con Howard Garner ”somos criaturas de nuestra cultura como lo somos de nuestro cerebro”

Para que los niños aprendan nosotros tenemos que saber como aprenden y para ello tenemos que conocemos hay que observarlos, ver como se mueven, como piensan, como hablan...; una vez que les conocemos es cuando podemos adaptarnos a ellos. Pongo otro ejemplo cercano mi propia hija, es una niña tranquila, sociable, muy amiga de sus amigas. En el colegio nunca habla si no la preguntan. Cuando tiene problemas ella intenta resolverlo, y si no lo consigue cuando llega a casa me lo pregunta, yo intento hacerla entender que tiene que preguntar en clase, que a su profesora esto le gustaría mucho (ya hemos hablado del tema) pero ella se resiste. La profesora cuando la ve atascada, la pregunta:

- ¿todo va bien?, Si dice sí pues nada, pero hay veces que dice no, y entonces la profesora la ayuda…

En casa muchas veces no hay niña, porque no se la oye, está en sus cosas.

Trabaja muy bien pero es lenta, es laboriosa, no es perezosa, pero le gusta el trabajo bien hecho. Si no se le da el tiempo necesario para cumplir su tarea, ella pasa… Un día trajo todas las cuentas mal, y cuando la pregunte me dijo que había puesto los números al tuntún porque era imposible, no tenía tiempo y lo importante era acabarlo, si no no podía salir al recreo.

Evidentemente a mi hija lo mejor es decirla, hazlo y si no terminas te lo llevas a casa…. Si la metes prisa o se siente que no llega pierde todo el interés por lo que hace. Tengo en casa un caballo pintado, lo hizo a ratitos durante 2 meses, jamás la dije que se pusiera a colorearlo, porque era un trabajo muy minucioso, tenía 7 años cuando lo hizo, la mayoría de los niños con su edad jamás hubiesen hecho este trabajo. No le cuesta concentrase lo que le cuesta es desconcentrarse.

Dependiendo de nuestra cultura cambia nuestro aprendizaje, por lo que hay que tener muy presente a quién enseñamos y qué enseñamos además del cómo enseñamos.

Evidentemente que sí, yo me críe en una cultura diferente a la de hoy, en mi mundo se aprendía por observación, veías hacer punto y aprendías, veías hacer bainica y aprendías, jamás me explicaron cómo hacer una tortilla, veías y lo hacías, para aprender a escribir la profesora copiaba en la pizarra tu veías como lo hacía y aprendías. Hoy todo va muy deprisa, no hay tiempo para ponerte a ver como se hace algo, dime cómo se hace y ya lo hago yo. O déjamelo escrito, o dime donde puedo encontrar tal información, cuando yo me pasaba horas mirando en la enciclopedia familiar. O los niños con los aparatos electrónicos, ¿quién de ellos se pone a mirar en los libritos explicativos? Ellos cogen el aparato en cuestión y tocando llegan a conocer lo más básico y se preguntan entre ellos ¿Cómo has conseguido eso?...

La cultura marca mucho. Por eso tenemos que conocer muy bien a los niños que tenemos. Tengo una amiga China, que le costó mucho adaptarse a España, llegó con 12 años de Taiwan, y nadie se preocupo por cómo era y cómo aprendía, tuvo que adaptarse sí o sí. No fue justo.

Para aprender una segunda lengua por ejemplo también se tiene que aprender la nueva cultura de donde proviene esa lengua para que puedan adaptarse a ella y aprender con sentido, tienen que aprender fundamentos de la lógica de la cultura a la que pertenece esa lengua con lo que esto evidentemente marca a los niños, y necesariamente marca el aprendizaje. Cuando mi hija veía los programas ingleses infantiles donde siempre terminaban con tartas en la cara, ella se extrañaba y me preguntaba por qué hacían eso, y sobre todo porque se reían. Pero ahora la gusta mucho Mister Been, ha comprendido el humor inglés, y hay veces que ella se ríe y yo no le veo la gracia.

Con lo que el aprendizaje de otra lengua nos hace aprender a comportarnos de otra forma, ni mejor ni peor, simplemente diferente.

Hay otros factores que influyen en el aprendizaje como los niveles adquisitivos y culturales familia el tipo de sociedad a la que pertenece, y hasta el entorno.

No es lo mismo vivir en un pueblecito en la montaña, que en la costa, o que en una ciudad. No es lo mismo ir a un colegio con una determinada ideología y metodología.

Defiendo esto porque cuando he dado clases particulares, he visto como influyen el entorno. Niños que se quejaban de no comprender nada, y el problema era que no se concentraban, estaban en el campo, pensando en las actividades de después del cole, en la mosca que pasaba, no tenían hábito de lectura, y menos comprensión al leer. En el colegio fracasaba porque eran despistados, y es que no les daban pautas, en el momento que se le puso unas pautas de trabajo, un horario para cada cosa, después de un mes de acompañarle, comenzó a funcionar muy bien, necesitaba que alguien le marcara el paso que ellos no sabían marcarse. Este tipo de niños en un colegio dirigido y bien pautado no habría tenido ningún problema o con un trabajo estructurado en casa (homeschooling), sin embargo a mi me mató lo contrario mi colegio era muy estructurado te lo daban todo pensado, mucho conductivismo y yo necesitaba que me dejaran sola con mi creatividad. Era capaz de aprender más cosas sola que en el cole, porque me gustaba investigar en los libros de mis hermanos y primos. Y me gustaba hacer murales, cortar fotos de revistas y hacer artículos…que después nadie veía y terminaban en la basura. En mi colegio la creatividad era fantasía que perjudicaba el aprendizaje. Pero cuando había que explicar que era un volcán o cómo funcionaba el cuerpo humano, o por qué flotaba un barco la única de la clase que podía explicarlo era yo, creo que muchas veces sabía más que los profesores.

Cada niño cuando llega al colegio, ya trae mucho aprendido, y depende de cómo haya adquirido ya esos comienzos va a continuar, nosotros podemos ayudar a aprender de otras formas, pero fijándonos en cual se adapta mejor a él. Un niño memorizará y asimilará mejor un vocabulario cantándole, otro viéndolo, otro contándoles un cuento, y es eso lo que tenemos que hacer adaptarnos a ellos, para que ellos consigan aprender mejor y les resulte más ameno y fácil.

Cuando hablo de colegio siempre me refiero al espacio donde se va a realizar el trabajo, que incluye niño-alumno, madre o persona que se encarga de la educación-profesor y todo esto da igual que se produzca en casa o en un centro escolar.

Espero que hayan aprendido, y piensen en cómo son sus hijos o alumnos para darles la oportunidad de aprender mejor.

¿SE PUEDE EDUCAR LA AGRESIVIDAD O HAY QUE NEGARLA?

Hola a todos. En el post de hoy voy a tratar un tema que por lo general inquieta a casi todos los padres / madres. La idea ha venido de un mail que me enviaron recientemente, muy similar a preguntas que me hacen muchas veces en mis ponencias.

Lo que me pidieron es mi opinión sobre cómo actuar ante la influencia que puede ejercer la agresividad de otros niños, la televisión, etc. en nuestros hijos. En este caso en cuestión la influencia agresiva la ejerce especialmente el primo del niño pero mi respuesta va enfocada a toda situación, al concepto en sí. ¿Quién no se ha preguntado alguna vez si ha de permitir jugar a sus hijos con pistolas o no? Se hacen comentarios como “No como animales o no soy partidario de las guerras pero en cambio a mi hijo le encanta jugar con pistolas ¿Qué he hecho mal?” “¿Es innata esa agresividad en el ser humano?” O un… “¿Hasta dónde puedo coartar la elección de amistades de mis hijos?” Realmente son preguntas sencillas, aparentemente tontas, pero que en realidad nos han dejado a muchos varias noches en vela o creado muy malas sensaciones.

Creo que ante temas así no hay una respuesta única o universal, sino más bien variable en relación con el niño, su entorno, la cultura de donde vive, nuestros propios sentimientos e intuiciones y consciencia, etc. Pero lo que sí puedo hacer es comentaros mi experiencia al respecto. El cómo yo he actuado en esos casos y cual ha sido el resultado.

En primer lugar recordaros algo muy importante y que tiene mucho que ver con la tolerancia y es el que por muy agresivos que os parezcan otros niños, siempre habrá otros más agresivos aún que influirán en esos niños y crearán también quebraderos de cabeza a sus padres.

Y ahora, mi respuesta:

Mi concepto es que los padres (ambos) son los principales responsables de la educación de sus hijos, de su desarrollo integral, de la amplitud de su consciencia, especialmente si conviven con ellos. Y en segundo lugar, los padrastros, madrastras y padres que no conviven con ellos.

Por mi parte, yo intento darles libertad a mis hijos pero siempre sólo si les ayuda a crecer en consciencia y autocontrol. A mí no me vale eso de "No quiero manipularles" pues en mi concepto, TODO es manipulación. Si no les manipulo yo, les manipula el vecino, el amigo, la abuela, el cantante de rock, los comercios, las películas, etc. Así que hace tiempo ya decidí manipularles del modo más fino posible. Siempre con la meta del beneficio grupal, no personal o propio.

Si el niño que influye negativamente en mi hijo no perteneciese a la familia, casa vecina, etc., dificultaría las posibilidades de citarse con él facilitando otras con otros niños menos agresivos (o con familias con valores y metas más similares a las mías) aunque esto me supusiese más coste, tiempo de transporte, etc. Pero no pararía de seco la relación porque por otro lado es MUY IMPORTANTE que el niño aprenda a auto controlar y manejar los efectos que las influencias negativas tienen en él y en su vida ya que a lo largo de toda ella siempre habrá diferentes influencias que penetrarán muy fuertemente en él o en sus personas cercanas. Si desde niño aprende a manejarlas, genial. Y eso no significa que tenga que parar su expresión de agresividad sino que sea consciente de ella.

Y aquí viene lo que yo también he hecho independientemente de si el otro niño es un miembro de la familia o no: Le he permitido a mi hijo estar con él. Por supuesto, en mi hogar imperan mis valores, considerándolos imprescindibles como base de aprendizaje en el día a día. Por ello no han podido jugar a juegos agresivos. Sólo a los “agresivos suaves” y escasas veces, a los fuertes, pero siempre estando yo presente y jugando con ellos. Al hacerlo, aprovechaba para decir de vez en cuando alguna frase de consciencia en él y sobre todo, le daba una meta al juego agresivo.

Pero fuera de casa (o de mi sitio de trabajo) sí se lo he permitido aunque luego siempre o casi siempre les hice ver cómo les alteró el juego. ¿Que cómo se lo hacía ver? Pues según la situación, con preguntas o comentarios del tipo: “¿Te has dado cuenta de que ahora estamos en casa y sigues agresivo? Te cuesta parar...”; “Un verdadero guerrero tiene mucha disciplina y un grandísimo respeto al anciano de la tribu ¿Lo tienes tú?, ¿Quieres tenerlo? Pues déjame que te enseñe sobre ello”; “¿Qué es lo que hace que te sientas bien cuando juegas agresivamente? ¿La liberación de la energía? ¿El sentimiento de poder y dominación? ¿Mayor seguridad en ti mismo? ¿Ego?”; “Juegas con él a eso para sentir que eres mejor y más fuerte pero en realidad lo es él porque antes de jugar con él, tú estabas más amoroso, obediente, tranquilo y en armonía que ahora por lo que en verdad es él quien ha vencido ya que te ha dominado hasta el punto de cambiar tu estado emocional a mayor desagrado, desarmonía y alteración en vez de cambiárselo tú a él a uno de mayor relax y armonía”; “Cuando eres más mayor el mundo es mucho más difícil y con más sufrimiento para alguien que actúa y se relaciona con agresividad que para el que lo hace sin ella. La gente se arrima al agresivo por miedo o admiración pero en cuanto tienen la oportunidad, le derrumban o le dejan solo y se ponen sobre él. En cambio, al que no es agresivo y es armonioso, comprensivo y tolerante, se arriman a él por amor y para sentirse amados por lo que nunca le abandonan y siempre le recuerdan. Ése es un líder natural y permanente, de por vida. No uno impuesto o que se impone, el cual siempre será temporal...” Con mis hijos me esforcé mucho en hacerles ver, sentir y entender todo este tipo de expresiones y enfoques aquí puestos.

Y por último, solía intentar darle siempre otro enfoque al juego agresivo, darle una meta enfocada a un beneficio social. Por ello, al principio jugaba con ellos muchísimas veces a este tipo de juegos intentando enseñarles a jugar agresivamente. ¿Formas de hacerlo? Pues les estimulaba a sentir, por ejemplo, que eran unos guerreros medievales defendiendo a varias familias campesinas atacadas por unos ladrones y violadores; O un bombero luchando contra un loco descontrolado que con hacha en una mano y mechero en otra quiere quemar un centro comercial. Y, aprovechando que en el juego era un guerrero y que los niños unen el juego con la vida diaria, le daba mayores responsabilidades en la casa: “Ok, puesto que eres un guerrero tienes que mostrar y entrenar tu valía así que ahora vas a ser tú el valiente que saldrá ahí fuera, a este planeta que está siendo invadido por los marcianos, y tirarás la basura todos los días”; “Ok, entonces, como valiente que eres, tú serás siempre el encargado de ir a dar los recados a los vecinos”; “Ok, como eres un guerrero y has de estar fuerte y entrenado, a partir de ahora tú llevas dos bolsas de la compra cada vez o la cesta de la recolecta” “Ok, como quieres ser un jefe guerrero, primero has de aprender de estrategia pues sino, las otras tribus (o países) siempre te vencerán así que tienes que aprenderte los nombres de las ciudades, pueblos, cadenas montañosas, ríos, etc. de este o estos países y dibujarme la ruta de ataque que consideres sería mejor”; “Tenemos que rescatar a nuestro compañero de la Torre de Londres así que has de estudiar su construcción y mañana iremos a salvarle”, etc., etc., etc.

Les hacía ver, sentir que la agresividad, el ataque, las guerras, etc. siempre tienen una responsabilidad y una consecuencia. Y cuando han sido más mayores, hemos visto juntos películas históricas (reales) bélicas especialmente desagradables y duras. Mi intención era que no identificasen la guerra con gloria, honor o beneficio para alguno de los bandos.

Considero importante tener en cuenta que no consiste en que nosotros luchemos con los niños y con sus gustos e intereses personales, sean influenciados y dañinos o no. Si hiciésemos eso, al transmitirles el mensaje de que tienen que ser, actuar o jugar de otro modo (con menos negatividad o agresividad) lo haríamos de un modo agresivo, por lo que consciente o inconscientemente los niños sentirían una contradicción de por nuestra parte lo que llevaría a que no nos respetasen o no nos hiciesen caso o a que nos temiesen, cerrando su corazón o comunicación para con nosotros más y más.

Consiste en que se conozcan y se comprendan, en que se observen y observen tanto al amigo influyente como a otros que el niño valore y sean armoniosos. Consiste en que se entrenen en la adquisición del autocontrol… Los cambios sólo llegan de forma permanente y respetuosa cuando son hechos desde la ARMONÍA, no desde una lucha entre padres e hijos.

Mis hijos ahora tienen 15 y 14 años y medio. Muchas veces me encontré en situaciones como la que me han pedido opinión y actué de este modo. Mi experiencia es que, especialmente el chico (pues la chica a penas hizo uso de ellos) sacó más su deseo de juegos agresivos entre los 6 y los 9 años, aproximadamente. Luego, poco a poco fue dominándolos y aprendiendo más y más de autocontrol. Ahora son nada agresivos. Son adolescentes tranquilos y muy respetuosos y obedientes. Pero ante todo, lo que tenéis que hacer es confiar en vuestra propia intuición y observar con lupa cada reacción o consecuencia. Que este post sirva como reflexión e ideas cara a la acción a tomar. ¡Que lo disfrutéis!

II Congreso Homeschooling

Los días 25 y 26 de Noviembre de 2011, es decir, este viernes y sábado, se celebra el II Congreso Nacional y I Internacional sobre Educación en Familia-Homeschooling, en la Universidad de Navarra (Campus de Pamplona) centrado en la temática: “Innovación educativa, TIC y escuela flexible” con la cual se pretende prestar atención y profundizar en este fenómeno con las implicaciones educativas y sociales que trae consigo.

El año pasado, tuvo lugar en Valencia el I Congreso Nacional sobre Educación en Familia-Homeschooling y en él se estudiaron las cuestiones fundamentales relacionadas con la práctica del homeschooling desde los diferentes enfoques académicos en las ciencias sociales y jurídicas. Malena Martín presentó una ponencia en nombre de ALE, explicando las actividades de la asociación y también, de forma particular, participaron las socias Ketty Sánchez y Arantza Diez, contando su experiencia y, la entonces presidenta de ALE, Azucena Caballero, representando a Epysteme.

Este año ALE cuenta con cuatro respresentantes en el congreso:

Ketty Sánchez, presidenta de la CEEDA y representante de ALE, moderará la mesa de experiencias el sábado a partir de las 16:00

Kika Baeza, contará su experiencia personal "Cómo educar en casa me ha cambiado a mi", en la mesa de comunicaciones "Participación Familiar, TIC y Homeschooling", el viernes entre las 15:00 y las 17:15

Sergio Saavedra, componente del equipo legal de ALE, participará con "Derecho a la educación y derecho a aprender" en la mesa de comunicaciones "Equidad, diversidad, calidad educativas y Homeschooling", el sábado entre las 9:00 y las 11:00

Y a mi (Ana Pérez) me ha tocado seguir relatando las actividades de la asociación, en la mesa de experiencias el sábado a partir de las 16:00. En la redacción de la ponencia "Asociarse para defender el derecho a aprender en familia" han participado también como co-autores Fernando Orozco y el actual presidente, Daragh McInerney, aunque ellos no asisten al congreso.

Además, otras dos socias, de forma particular, participan en la mesa de comunicaciones del viernes "Participación Familiar, TIC y Homeschooling":

Mireia Martín, que junto con dos compañeras presentará "Homeschooling: innovación educativa, transmisión de valores y socialización".

Y Azucena Caballero, en nombre de Epysteme, con "Homeschooling con adolescentes: el gran reto"

También asistirán al congreso los socios Luis Diez y Francisco González.

Aprendizaje significativo

Hago referencia a una conferencia a la que no asistí pero me contó alguien que tampoco asistió, siento decir que no se donde fue ni quien era pero me gustó mucho.

Hablando sobre el aprendizaje, el profesor conferenciante muy en su papel dijo:

- Yo he enseñado a hablar a mi perro

Todo el mundo quedó expectante:

-¿Cómo es posible?, ¿Y qué aprendió?

Todos los asistentes se hacían preguntas de este tipo. La contestación del profesor fue:

-Yo le he enseñado, es su culpa si no ha aprendido.

Y es que yo veo a este concepto desde dos vertientes:

Desde la visión del alumno y desde la visión del profesor. Todo lo que consigue aprender un alumno evidentemente es un aprendizaje significativo, sino no lo habría aprendido.

Pero desde el punto de vista del que enseña, qué es un aprendizaje significativo. Para mí y para no meternos en profundidades, aquel aprendizaje pensado para que realmente alguien en su nivel de capacidad y posibilidad pueda aprenderlo.

Es decir si tengo un niño normal, con 6 años y quiero enseñarles quebrados tal cual el conocimiento puede ser bueno pero si el niño no esta aún maduro para comprender este concepto da igual que yo se lo expliqué de mil maneras...Podre partir una pastel en dos y decirle mitad para ti y mitad para mi, hasta podré escribir la representación gráfica, pero a partir de aquí, este conocimiento es absurdo. El niño no tiene desarrollado ni la lógica suficiente ni el nivel abstracto. Hay que saber que queremos enseñar y a quién. La reflexión es necesaria cuando enseñamos.

Defensa de la educación en casa

Soy defensora de la educación en el hogar, en el micromundo, mesomundo, y macromundo del niño. Ahora la pedagogía está defendiendo la educación personalizada, es decir, una educación pensada en las necesidades individuales de los niños, (del estudiante tenga la edad que tenga, estamos en un momento en que aprender es una necesidad durante toda la vida), muy bien pues eso es lo que quieren desde hace mucho los padres para sus hijos y por eso los dejan en casa para darles una atención personalizada, y quien mejor que la familia para conocer a su hijo.

Hace poco en una charla, alguien que sabía que era estudiante de la Carrera de Grado de Maestro, me dijo sarcásticamente: tú defiendes la educación en casa pero quieres ser maestro, te contradices ¿no? Pues no, le conteste. Y para todos los que quieran saber el porqué lo explicaré, me gusta aprender, tuve dificultades de pequeña, me gusta ayudar a aprender. No estoy en contra de los colegios, cada cual es libre de elegir lo que desea para sus hijos. Pero comprendo perfectamente a los padres que defienden el derecho a otra forma de vida para toda la familia, y que no ceda sus responsabilidades a otros sino que ellos mismos en conciencia respondan a la sociedad dando un pequeño tirón de orejas, “a mi hijo lo educo yo”

Por un lado la educación y la instrucción son completamente diferentes, después lo explico. Pero en la respuesta de la profesión que me gusta y que estudio tengo una cosa que decir, seré profesora de niños no de escuelas, las escuelas no aprenden, yo no necesito una escuela para ser maestra necesito niños a los que instruir y si los padres quieren, educar.

Un padre tiene derecho a elegir que educación quiere para su hijo, la moral que va unida a las costumbres, muy diferente dependiendo de culturas y religiones. La instrucción es agua de otra cántara. La sociedad hoy reclama que nos niños no son educados en los colegios, claro señores es que los niños deben ser educados en casa e instruidos en el colegio o en el lugar donde sus padres decidan. Y deberían poder elegir el profesor que a ellos les interesara. Es decir, si eres un buen profesor y lo demuestras tienes cache y si no ponte las pilas. Pero es muy fácil ser profesor en escuelas donde los niños van porque tienen que ir y cuando fracasan la culpa por supuesto o es del niño que es tonto o del padre por no tener tiempo para el niño, o cosas peores.

La institución escolar es un gran invento tanto que ha desplazado al profesor, la institución escolar para subsistir necesita del profesor y de los niños. Si los niños se quedan en casa, y los profesores atienden a estos en sus casas, pongamos por ejemplo ¿qué pasa con la institución escolar? Nada debería pasar, ya que lo importante es la educación del niño y su instrucción, el lugar debería ser lo de menos, a no ser que se trate de que todo el mundo sea igual y entonces la educación personalizada que se quiere imponer en los colegios sea una milonga, con perdón. Y qué conste que a mí me gusta la educación personalizada. Y no tanto la diferenciada, que no tiene nada que ver. La educación diferenciada es aquella que diferencia uno de otros, niñas por un lado y niños por otro, esto que según que religiones lo defienden para mí no tiene sentido ya que en la sociedad los niños y las niñas serán hombres y mujeres que tienen que aprender a convivir y cuanto antes mejor. Pero podemos defender la educación diferenciada si la enfocamos en las diferencias individuales de cada niño y entonces nos encontramos que nos lleva a la educación personalizada, a cada diferencia una personalización, según las necesidades.

Pero cuidado, Si educamos e instruimos a los niños teniendo en cuenta lo anterior, ¿el mundo de después va a estar hecho para que cada uno pueda ser diferente?, porque si después tenemos que aprobar unas oposiciones donde las preguntas sean iguales para todos…y los requisitos no tengan en cuenta estas diferencias….resulta que los que hayan recibido una educación clásica, apréndete el ladrillo, recuérdalo, no lo reflexiones contesta sin error, serán los que tengan más posibilidades de aprobar estas oposiciones ficticias Tendremos un desastre para aquellos niños felices por decirlo de algún modo.

Creo que si bien es verdad que la competencia actualmente respecto al aprendizaje es aprender a aprender durante toda la vida, hay que saber qué se aprende, cómo se aprende y para qué se aprende durante toda la vida. El tiempo es precioso y valioso.

Y es que cualquier sitio es bueno para aprender

Por ello veo que el cambio de mentalidad es necesario, que los padres que quieren responsablemente educar a sus hijos tienen el derecho y el deber de poder hacerlo. Y que los profesores deben respetar, y recordar que los niños son niños allá donde estén, y que son los padres los que deben elegir a dicho profesor en el caso de que lo necesiten. Sin que sea necesaria la Institución Escolar.

En casa los niños tienen su mesomundo y su micromundo, la calle, el pueblo o ciudad su macromundo, tienen la educación e instrucción indivudualizada, y mucho tiempo para socializarse, para hacer actividades que les guste y les ayude a crecer en la sociedad a la que pertenecen.

Cuando la gente que no conoce realmente que significa Homeschooling se ponen en contra sencillamente es por desconocimiento, lo mejor que le puede pasar a un niño es pasar su infancia con sus padres, el ser humano necesita de su entorno directo para desarrollarse humanamente, y por mucho que queramos una profesora con veinte niños por muy maravillosa que sea no podrá atender a todos personalizando sino establece un punto de partida.

Mi felicitación a todos aquellos que pudieron cumplir sus sueños.

Me quiere, no me... ¡Pues claro que me quiere!

No dudo que las familias que mandan a sus hijos e hijas a la escuela les quieren... No dudo que las familias que educamos en casa queremos a nuestros hijos e hijas. Todas hacemos lo que creemos que es mejor para que vivan (no sólo para que sobrevivan) en este planeta.

El amor es incondicional cuando te comprometes con la educación y la crianza de tus hijos/as, cuando decides “hacerte cargo”, no “actuar en tu descargo”...

Me acuerdo de aquello de deshojar la margarita, para ver si alguien me quiere o no. Nuestros hijos/as, educados/as en casa, no lo van a dudar ni un instante: no necesitan la margarita, no tienen dudas al respecto... Pero sí podrán echar mano de otra flor, tan bonita o más que la margarita: la flor de la permacultura.

¿La perma-qué...? La cultura permanente, el arte, la ciencia, el sentir y el hacer de otro mundo posible. De un mundo real que genera entornos habitables por el ser humano sin actuar contra la naturaleza, ni contra otros seres humanos... Nada nuevo oiga, no nació ayer...

La permacultura promueve una relación armónica del ser humano consigo mismo y con su entorno, satisfaciendo sus necesidades alimentarias, de vivienda, de hogar, de vestido, de agua... desde una óptica de lo que hoy llamarían por ahí “sostenibilidad”, pero mucho más allá, sostenibilidad de la buena, no de la panfletaria política...

Porque dentro de la permacultura no sólo hay técnicas o herramientas (como la agricultura ecológica o las energías renovables), sino una verdadera transformación socio-económica y cultural que hace al ser humano más humano, más natural, más racional... (¡qué contradicciones más lindas y factibles!).

Y hete aquí que dentro de la permacultura se define un ámbito específico para trabajar sobre esta transformación “revolucionaria”: educación y cultura. Y dentro de ella encontramos como ejemplo: ¡la educación en casa!

10 buenos hábitos que te ayudarán a organizar el estudio de tu hijo

Ten todo el material de estudio de tus hijos reunido en un mismo espacio y lugar, de esta forma será más sencillo tener todo lo que necesitan a mano y no perderán tiempo buscando cada cosa por un sitio de la casa.
Clasifica el material de uso cotidiano de cada uno de tus hijos en un lugar específico solo para ese hijo, puede ser una balda de una estantería, un revistero de cartón, una caja de plástico…
Clasifica el material impreso que tengas por áreas y ciclos, usa un archivador que vayas actualizando constantemente, o revisteros de cartón con etiquetas (ciencias de 4º, lenguaje de 6º, etc.
Ten cestas, cajitas, botes, etc., donde los lápices, colores, rotuladores, pinzas, gomas, sacapuntas, encuadernadores, chinchetas, etc., estén clasificados y al alcance de la mano de forma fácil.
Dedica cada día un rato a pensar y preparar qué haréis mañana. Tener todo a punto te adelantará mucho el día siguiente.
Cada día, al terminar vuestro tiempo de estudio, haz que tus hijos te ayuden a recoger y dejar todo en su sitio de nuevo, así mañana lo podrán volver a utilizar con facilidad.
Utiliza un temporizador. Tiene varias utilidades, por un lado sirve para que el niño sepa que solo estará haciendo esa actividad equis minutos si se trata de algo que el niño no disfruta tanto pero tú consideras que es necesario que lo haga, saber que son solo esos minutos y no más les ayuda a concentrarse y sacar adelante esa tarea que saben que tiene un fin cercano. Por otro lado, cada vez que dejes a los niños haciendo solos algún trabajo y tú te vayas a la cocina ponte un temporizador y cada 20 o 30 minutos, cuando suene, ves a ver cómo van, si necesitan ayuda, etc.
Revisa cada año que material quedó ya obsoleto para la edad de tus hijos y deshazte de él, regálalo, dónalo, o tíralo si no lo puede aprovechar otro niño ya. Vaciar de material que ya no utilizas tu casa dejará más espacio para ordenar y organizar mejor el que sí usas y para poder adquirir nuevo material que te interese.
Lleva control de todo lo que estáis haciendo y de lo que tenéis pendiente en una agenda o planificador. Anotar todo te ayudará a que cubras lo que vayas dejando y a enfocarte en tus objetivos para con el estudio de tus hijos.
Programa sesiones regulares en tu agenda para revisar lo que estáis haciendo y cómo y si hay alguna cosa que deseas modificar o hay algo que quieres implementar, etc. La revisión constante de lo que se está haciendo te ayuda a mejorar y a adaptar lo que haces a las necesidades de tus hijos todo el tiempo.

Ale en la Universidadad Popular de Logroño

La Universidad Popular de Logroño es un Centro de Educación no Reglada que se inscribe dentro del proyecto de Universidades Populares implantado en diversos países europeos y del sur de América. Organizan cursos y talleres para adultos, desde las distintas áreas que lo conforman.

Este año, el área de Crianza, ha organizado unas Jornadas Educativas, distribuidas en cuatro fines de semanas a lo largo de todo el curso y dedicadas a cuatro temas: escuela libre, escuela Montessori (primaria), escuela pública y homeschooling, con el fin de analizar el sistema educativo actual y de conocer distintas formas de educar.

Para el tema del homeschooling, quisieron contar con Ale y allí estuvimos el pasado 5 de Noviembre. A las jornadas se habían apuntado 17 alumnos, la mayoría padres de niños pequeños o profesionales de la educación. Mostraron mucha curiosidad por el tema, del que concocían muy poquito. Las tres horas se pasaron muy rápidas. Los alumnos no quisieron parar para hacer un descanso e hicieron muchísimas preguntas.

Por mi parte, era la primera vez que presentaba formalmente nuestra forma educativa y disfruté la experiencia. Llevaba prepardos varios temas, en pequeñas presentaciones para poder adaptarme a los intereses y preguntas del alumnado, al igual que hacemos en casa.

Me entero horrorizado por un artículo publicado en la sección de sociedad el pasado 8 de este mes, del terrible maltrato que promueve el libro Cómo educar a tus hijos del pastor evangélico de Tennessee, Michael Pearl y que ha conducido a la muerte de varios niños en los EEUU.

Sin embargo, el artículo sorprende al relacionar los dramáticos hechos con la educación en casa o Homeschooling, generando infundadamente un clima de desconfianza y aún de alarma social sobre dicha práctica. El uso de los datos hace creer al lector que tal práctica educativa está necesariamente ligada al fundamentalismo religioso, al confinamiento y maltrato infantil, nada más lejos de la realidad de una práctica que implica a dos millones de niños en EEUU, una opción cada vez más conscientemente elegida por una gran variedad de familias en todo el mundo, precisamente por un especial celo en el bienestar y desarrollo de niños y niñas.

En primer lugar, el maltrato infantil, o terrorismo adulto doméstico, es un serio problema que según un informe de Unicef de 2003, causa la muerte de 3500 menores al año en los países ricos, la gran mayoría de ellos en EEUU, México y Portugal. Esto constituye tan sólo la punta del Iceberg de una lacra social que se estima de alrededor de 200 casos de maltrato físico por cada muerte, lo que nos acercaría a la cifra de un millón de niños que sufren agresiones en el ámbito familiar en los países desarrollados. La prensa no presta demasiada atención a una cuestión, el uso de la violencia sobre niños y niñas, que hasta hace poco estaba legitimada y legalizada, y que aún hoy sigue siendo considerada por gran parte de la sociedad aceptable y necesaria en diferentes grados: desde los partidarios del cachete y los convencidos de la zapatilla, hasta los fanáticos de la vara y el látigo, como el infame pastor de Tennesse.

Por otro lado, estudios realizados en EEUU y en España, revelan que la cuestión religiosa no es la primera motivación de quienes deciden educar al margen de la escuela convencional. El homeschooling es un movimiento plural que reúne en su seno muy diversas tendencias y estilos de vida y aprendizaje. La mayor motivación para elegir la educación en casa en España, según el estudio realizado por el profesor Carlos Cabo, dista mucho de ser la religiosa, moral o ideológica. Los homeschoolers en España apelan a razones pedagógicas y, curiosamente de socialización, como los principales motores de su decisión. Si bien en EEUU la realidad es que los motivos religiosos son muy significativos, comparten relevancia con la preocupación por el entorno escolar y la desconfianza en la pedagogía oficial, según un informe del departamento de Educación de los EEUU de 2007. Tanto en EEUU como en Europa, los homeschoolers cubren todo el aspecto ideológico, desde los más conservadores hasta los más progresistas. Todos parecen compartir un especial interés en proporcionar a sus hijos mayor bienestar y capacidades de crecimiento que los que la escuela tradicional parece ofrecer, asumiendo para ello hasta el final su responsabilidad como padres.

Por eso, unir en el imaginario del lector estas dos realidades, es falsear ambas, convirtiendo el maltrato infantil en un hecho anecdótico que implica a fanáticos religiosos de otras latitudes - cuando es un problema extendido por todo el mundo y presente en todas las capas de la sociedad, que ocurre en la puerta de al lado y del que se hace con demasiada frecuencia oídos sordos, y al mismo tiempo desprestigiando un movimiento global y plural, que busca principalmente la libertad educativa y la convivencia en paz de la diversidad. Lamentamos profundamente que cuando se tocan estos dos temas de rara aparición en los medios, se haga para frivolizar un serio problema y criminalizar a un colectivo inocente.

Those considering a campaign for change must therefore balance the pros and cons of the situation very carefully. Does the probability of the hoped for gain outweigh the possible cost of loss?

It is for this reason that home educators in the UK, who have much to loose, have rightly refrained from approaching their government for further concessions.

When legislation is proposed, all those with an interest in education or children, become involved in the process. Organisations that home educators almost never come into contact with, as well as those who are well known adversaries, enter the debate.

During the recent attempt by the UK Government to introduce new legislation in England, under what has become known as the Badman Reforms, organisations such as the NSPCC, a children’s welfare charity; the Church of England; St Barnardo’s, who run children’s homes; several teachers unions; the Parents Teachers Association, which represents those who volunteer as school governors; local education authorities; The Probation Service; Connexions, who offer careers advice and government monitoring of teenagers in the UK and even the Crown Prosecution service; to name but a few, all wrote, quite often statistically erroneous and misinformed statements, to government ministers, members of parliament and possibly most damagingly to the press, denouncing home educators and all our works.

By the time the review had ended, many members of the public had the idea that home educating parents were all paedophiles even to the extent that a few families reported that their children had been subjected to very damaging and hurtful taunting from other children who had no doubt overheard conversations between their parents.

The accusations ranged from forced marriages to criminality, abuse to neglect. None of which had any foundation in reality. Since then there has been a noticeable rise in the interest paid by Social Services departments to home educating families.

As legislation passes through the legislature many organisations lobby its members, adding damaging amendments, we had one such amendment to a regulation recently in the UK that would have led to a significant delay between a family asking for a deregistration to obtaining one, something we have worked hard to prevent for many years. An article in the HEM magazine from the USA – an article that I recommend people to read – shows that this problem is also well known in their;

“it is usually a mistake for minorities like homeschoolers to try to have legislation introduced to support them. In the first place, as discussed above, statutes generally do not grant freedom; they limit it. In addition, it is very difficult to control legislation, which can easily be radically changed by amendments. Introducing homeschooling legislation provides a great opportunity for opponents of homeschooling to add amendments that increase government regulation of homeschooling.”

An additional complication is the behaviour of ones allies, which may not be all that one could hope for. During the same ‘Badman’ review in the UK, the government considered what became known as the Tasmanian Model. This was a scheme based upon home education regulation in Tasmania.

Basically a government appointed committee made up of representatives of the home education community and government appointees; would appoint inspectors to regulate and monitor those who would be permitted to home educate.

The effect of this in Tasmania was to incorporate the only home education support group families had into the government apparatus thereby effectively removing any and all opposition to government control of how home education is undertaken. The last time I spoke to a Tasmanian home educator I was told the government had decided to do without the home educators on the regulatory panel and staff it with state officials, thus completing the takeover. All that remains now is for them to step by step remove parent’s rights to home educate with little or no organised opposition.

The suggestion to adopt this structure in the UK was pounced upon by a small group of home educators – the very same group who were widely seen as those best placed to become that committee. They presented a paper detailing how it might be done. This was produced without consultation with any other group or even their own membership. The sense of shock and betrayal was immense and it's effect was to undermine the strategies being followed by other groups.

In the USA HSLDA has itself been accused of negotiating rights away. From the same HEM article we have;

“HSLDA's actions have eroded the foundations of our freedoms. From the beginning, HSLDA has relied on statutes in two ways. First, in its misguided attempts to get statutes it mistakenly thought were necessary to make homeschooling "legal," HSLDA has made compromises that have reduced the freedoms of homeschoolers in several states. Second, in initiating court cases to overthrow statutes, HSLDA has contributed to the development of a body of case law that supports unnecessary government regulation of homeschooling.”

Similarly it can be argued that HSLDAs involvement in European court cases have led to weak, doomed cases², being taken to the highest European courts and the European home education community being stuck with the resulting poor, restrictive case law that effects all families throughout the European Community.

Cases brought in Germany have led to the popular conception there that the issue of home education is one entirely associated with extreme religious views to the extent that a few years ago a national newspaper ran a poll conflagrating the issue of home education with religious extremism. When I debated the issue of home education on the BBC world service with a German professor of education a few years ago I was told home education was anti democratic (which I eventually understood to mean anti socialist) and socially divisive – what Germans call ‘parallel societies’.

Once an idea has established itself in the popular mind, it is extremely difficult to alter it. Taking controversial and difficult cases to the European courts has, in my view, skewed the popular view of home education in some parts of Europe and put the cause of home education back by decades.

The history of legislative change in home education regulation is peppered with examples of how one group or another has negotiated away rights and freedoms because they were not seen as important to the needs and requirements of that particular group.

Oppressive governments pounce upon those divisions and bit by bit negotiate away freedoms necessary to autonomously educate our children. What then might an alternative approach look like?

I think a great deal of ground work is necessary before we attempt to change anything. The watershed in the UK came in 2001 when one of our national TV channels covered home education allowing families to talk about their experiences following families as they lived their lives.

It showed home educators as normal families, caring about the future of their children. It showed intelligent, aware, well socialised kids in whom their parents could be justly proud. The programme was aired on a Friday evening and by the following Monday home education support websites were reporting visitor stats as doubling. This interest in home education never fell back; it continued to steadily rise from that date on.

From then on when a family mentioned home education to friends and family, or even strangers asking why they children were not in school, there was a fair chance that the other person had at least heard about home education and were far less likely to be openly hostile. From this point on Home Educators were able to take a stronger line with the authorities. In the few cases taken against families magistrates were less likely to take openly critical positions against families and local authorities began to invite representatives from local home education groups to speak to them.

The trick is to gain the empathy of the public. A campaign should not primarily be a legal fight, but one conducted in the press and over the internet. The purpose is to embarrass the authorities, making it hard for them to fall back upon ignorance and prejudice when justifying their poor treatment of us and make it difficult for them to prove tangible harm.

We need to engage the sympathy of members of local and national legislature to further weaken the authority’s position. Where we do ultimately take cases to court, only the strongest cases should be taken on. We should not take on causes we cannot win and certainly not take them to the highest courts where rulings can have such devastating effects.

We first need to establish links to the media and offer interviews all to clear the way for a sympathetic hearing. We cannot expect to win cases, change the law and take back control of our families by simply taking a case to court. We need to prepare the ground so as to make calls to prejudice more obvious and politically risky.

My younger child (James) is over 17, so I am almost at the end of my home-educating journey. I’d like to tell you a bit about it. Every family’s journey is different but I found it encouraging to look at the people ahead of me and I hope you’ll find something in our story from which you can take heart.

My parents were a skilled manual worker and a clerical worker in a small Scottish town. I grew up on a council estate in a not too good part of and attended our local secondary school, a comprehensive. I was one of very few pupils to go to university. In 1981, as I was leaving secondary school, I read a newspaper article about Education Otherwise and I filed it away for future reference. At that point, I decided I would home educate any children I had. I had not had a particularly bad experience in school but I was aware that it had been a huge waste of my time.

Fast forward to 1992 and then 1994, when my children were born in southwest London. Although I had not consciously thought about it in ten years, I still knew that I was going to home educate. I was working in the UK training department of an American IT company and I arranged to work from home 2.5 days per week. I also trained as a childminder and a friend and I minded other children in my home so that I could continue to earn but could be with my children most of the time. I joined a number of home educators’ email lists – which is where I “met” Mike and Neil, became a member of Education Otherwise (EO) and met up with people in the local support group. In the early 90s, much more than now, home education in the UK was an “alternative” activity that went hand in hand with extended breastfeeding, co-sleeping, raising children consensually, refusing vaccination and being ecologically aware. Articles in the EO newsletter were almost exclusively about autonomous education and I understood that that was “the way to do it”. Which was just as well because my daughter (Katherine) needed all that stuff and I had no experience with babies and small children so I needed to find a community.

So what did we do? For the first 14 years of Katherine’s life, we were very unstructured. We painted and drew; we made music and joined the local Saturday music school; we baked and cooked; we made presents and cards for family and friends; we attended church; we joined children’s clubs and sport classes; we did science experiments and computer games. Along the way, both children learned to do arithmetic and to read. It turned out that Katherine had social difficulties (she has had no formal diagnosis but shows signs of being on the autistic spectrum) and so my main aim for home education was to get her to being an adult who could pass for normal and with whom I could be a friend.

I also read a huge amount to both children. Not having trained as a primary school teacher, I didn’t know that reading needs to build on phonic blocks – and those of you who have learned English as a second language will already know that English is not regular enough for that to be the most important concept! So we mostly did not read books intended for beginning readers. We went to the library a lot and the children chose books that they enjoyed, without reference to whether they would be able to manage to read them. I was lucky – I never had to worry about how the children would learn to read. The EO newsletter gave reassurances that it would “just happen” and Katherine started to spot letters when she was about 2 years old, so I saw no reason to do anything other than just let it happen. In fact, even now, she has great difficulty hearing the phonic blocks. Katherine was given the complete Chronicles of Narnia for her fifth birthday and I read it to both of them – three-year-old James had no problems comprehending it and discussing the story, so I didn’t see any reason to push him to start to take an interest in decoding words. In fact, he did not admit he could read until he was rising 9, when he sat down and read the whole of Harry Potter and the Philosopher’s Stone in a week. I had not worried about it because he was able to spell words out for Katherine before his fourth birthday – it is very odd having a child who apparently cannot read but can spell perfectly! Also, when he was 8 and his father was anxious about him not reading, I had overheard Katherine saying to James “I don’t know how you can be bothered with Asterix books – all those long names.” James’s reply was “But the jokes are in the names.” So he was obviously reading – I didn’t need to know how!

Katherine is now at a good UK university, studying law with German law. She was admitted to the programme without any of the usual exams that young people take in school. When she was 12, Katherine decided to participate in the En Famille foreign-exchange programme. She spent six weeks in Zürich and the following year she spent six months in Germany, each time living with a German family (and attending Gymnasium). When she came back, we looked at a sample GCSE exam paper (which is usually taken at 16, the end of compulsory school age). We decided that it was below her abilities in German and so we signed her up for a course with the Open University (OU). The OU is a university that was set up in the 1970s to provide degrees by distance learning, mostly to mature people with other commitments, such as work and caring responsibilities. It was also intended to be accessible by people without the formal qualifications to enter a normal university, which makes it very useful to home-educated young people. After Katherine finished the German course, we decided that we may as well stick with the OU. She thought she might want to complete a degree in German, so she took a course in linguistics. Then she decided she’d like to do law at a normal university but to use her German as well. She studied maths and humanities with the OU so that she could demonstrate her ability to study. She applied to five universities for entry in autumn 2010. Exeter’s course is the best that she could do – one module of the four she studies each year is German law, taught in German. She will spend a fourth year in Saarbrücken and will graduate with both an English LLB degree and a German Legum Magistra degree. That will then allow her to go on to the professional courses to practice law in either country.

For us, home education has very definitely been a success. No-one can deny the academic success. And, after a year away from home, Katherine is able to say that she is grateful for the time I spent on ensuring that she could operate in social situations.

“Para educar, es preciso encerrar”: he aquí la justificación más zafia de la Escuela y uno de los dogmas fundacionales de la Pedagogía. Legitimado el encierro, los pedagogos podían definir su tarea: “amueblarlo”, “amenizarlo”, hasta “camuflarlo”...
Pero la falsía es evidente: entre “educación” y “escolarización” hay una relación compleja y una asimetría irreparable, que desautoriza toda pretensión de identificación. No, no se encierra para educar. Se encierra para otras cosas y se educa de muchos otros modos.
La educación pasa, ocurre, acontece. Ni siquiera es “deconstruíble”, cabría sostener en jerga de Derrida. Así como no podemos “desmontar” la Justicia, y sí el Derecho, se nos escapa la Educación pero no la Escuela. La Educación está siempre y en todas partes. Ya se la conceptúe como “moralización de las costumbres”, como “socialización”, como “transmisión cultural” o como “proceso de subjetivización”, la Educación no cesa y nunca falta. Y tenemos “educadores naturales”, como los padres; “educadores electivos”, como esos amigos que estimamos y escuchamos con especial atención; “educadores fortuitos”, como aquellas personas con las que chocamos y nos marcan duraderamente,... Y se ha conocido la “educación comunitaria”, como la tradicional gitana, como la que distinguía a las comunidades indígenas sudamericanas, como la que fructificó, antes de la llegada de los occidentales, en África Negra... Y existe la “auto-educación”, que opera a cada rato, cada vez que miramos, escuchamos, leemos... sin directores. En este vasto campo, dándose la Educación, no aparece la Escuela...

Hay, además, otro tipo de educador, otra figura educativa, una figura entre muchas y un tipo entre tantos: el “profesor”...
¿Qué es un profesor? Es verdad que se trata de un “educador”. Pero concurre una circunstancia que lo particulariza y que lo desvela, ostenta un rango exclusivo... Nos encontramos ante un educador mercenario.
“Mercenario” en la doble acepción del término, política y económica. En lo político, se halla inscrito en la cadena de la autoridad, aparece tal un eslabón en el engranaje del despotismo. Su lema, en palabras de Julio Cortázar, sería este: “mandar para obedecer, obedecer para mandar”. En lo económico, porque, como recordó Steiner, proclama consagrarse a la Causa Buena, a la Causa Noble, a la Causa Justa de la Humanidad y, a continuación, pasa factura.
El “educador mercenario”, agente meretricio, se “desata” en la Escuela. Trabaja, pues, para la escolarización, en y por el “confinamiento educativo”.

La Escuela (pública, moderna) surge en el siglo XIX para resolver un problema de orden público, para amoldar el material humano a las exigencias de la producción (la fábrica) y de la política (la democracia). Reforma moral de la población, tendente a forjar “buenos obreros” y “buenos ciudadanos”: ese fue su objeto. A partir de entonces, se abre una fisura descomunal, un hiato mayúsculo, en la historia de la transmisión del saber y de los procedimientos socializadores: se decreta la reclusión forzosa de la niñez y de la juventud, su confinamiento “educativo”. Desde esa hora y hasta hoy mismo, el “estudiante” se define como un prisionero a tiempo parcial.
Pero a la infancia no se la enclaustró, sin más, para “educarla”. Se la encerró y se la encierra para otras cosas...
La Escuela “sirve” para combatir y neutralizar las restantes esferas de transmisión cultural, las vías alternativas de socialización de los saberes, como apuntó A. Querrien -esferas y vías menos permeables a los proyectos político-ideológicos de la institucionalidad, a las proclividades adoctrinadoras del Estado. Como anti-calle, y para un mayor control de la subjetividad, la Escuela aspira a la hegemonía educativa.
La Escuela secuestra también para conferir a la “actuación pedagógica sobre la conciencia” la duración y la intensidad que requiere a fin de constituir hábitos y estructuras de carácter asimilados, y así lo denunció Bourdieu.
Y vale la Escuela, añadió Donzelot, para que la población “interiorice” la preeminencia del Estado, organización que impone el rapto temporal de la juventud y fuerza a los padres a cooperar en tal captura y en tal retención.
He aquí los propósitos prioritarios de la encarcelación intermitente...

Todas las escuelas conocidas y concebibles aceptan este horror del encierro, esta miseria de la asistencia obligada. Da igual que se prediquen “cristianas” o “libertarias”...
Las consecuencias sobre la psicología infantil de esa consentida clausura nunca serán analizadas con rigor desde los ámbitos académicos, pues manda la legitimación de la Escuela y para ella trabajan nuestros psicólogos, nuestros psiquiatras y nuestros pedagogos.
“Apuntes de la casa muerta”, de Dostoievsky, obra que en ocasiones se tituló asimismo “El sepulcro de los vivos”, arroja perspectivas más esclarecedoras a propósito de las formas de mentalidad colectiva y del haz de posiciones individuales de subjetividad que engendra todo dispositivo de encierro y toda ingeniería carcelaria. Un ejemplo: los daños, sobre la sensibilidad y sobre el comportamiento, de la privación de soledad, de la imposibilidad de estar a solas, centrado en uno, a salvo de la mirada ajena y de las pesquisas de los otros, privación que se daba en los presidios de Siberia lo mismo que se da en nuestros centros “educativos”.

No es fácil hacer el mal a sabiendas. No es sencillo mantener prácticamente “inmovilizados”, o “movilizados” bajo coacción, a un hatajillo de niños-reclusos; hablarles de lo que muy a menudo no les interesa; obligarlos a callar y luego obligarlos a hablar; evaluar su “escucha”, su “memoria”, sus “destrezas”; insultarlos desde la impunidad (“insuficiente”, “muy deficiente”, “suficiente”), etc., y regresar después a casa con la conciencia tranquila, el corazón intacto, la vida en paz... Se requería una disciplina que administrara el auto-engaño profesoral; que inoculara, a cada docente, esa dosis de “mentira vital” sin la cual, como apuntó Nietzsche, ningún ser humano puede soportar su jornada. Y apareció la Pedagogía, para persuadir al profesor de que laboraba en pos de la Causa Suprema del género humano, de que contribuía sustantivamente a la mejora de la sociedad, de que ejercía tal un vector de Progreso. Apareció, asimismo, para “readaptar” la máquina escolar a las distintas etapas, económicas y políticas, del Capitalismo; para “reformar” coyunturalmente los métodos, para optimizar las labores “reproductivas” de la Institución.

Toda pedagogía se definió, desde entonces, por este lado, como un “artificio para domar”, que diría Ferrer Guardia, y, por aquel, como “la bella mentirosa”, título de una película francesa. Justificaba el encierro domesticador y lo modernizaba.

It is the nature and intent of that delusion which I want to explore in this talk in the hope of better enabling us to know what it might be worthwhile to attempt to do to improve conditions for us as home educators, and what might be hopeless action or worse. Please bear with me if what follows does not at first seem to have much to do with home education. I promise I will try to justify its inclusion.

The state is the principle manufactory of mass delusion, and almost everything it does has this quality of appearing to be one thing, but really being another, usually opposite thing. Parliaments are really now reduced to little more than pantomimes, staged to entertain us with the illusion of sovereign government we voted for, as it simply dresses up and puts into place the directives of global governance to which it is signed up and legally committed to. Much of what passes for national policy can be found in the EC Lisbon 10 year strategies (1) and in the UN Agenda21 (2) for example, but these are not the only sources. There is a vast bewildering world of more institutions than it is possible to imagine let alone remember out there, all dedicated to expertly determining for us how we shall all live, and what we will think and believe and even feel about it all. Web surf through this morass sometime if you have never done so, and you will begin to understand your intended place in the totally managed world.

Only the other day I stumbled across the International Union of Local Authorities (3) which has been going for 98 years - pause to take in the possibility of anachronism here! If you have ever wondered how local government in one country can manage to oppress home educators in seemingly identical ways with identical prejudices and modus operandi, then here is a contender for one efficient mechanism for globalising bad practice! Amusingly in attempting to re-source this organisation I fell over another couple in the same field before finding my way back to this one. One of them cheerfully informed me that half the legislation affecting local government came from the EC.

So, even the institutions of local and national government itself as we are taught to understand them are mostly a delusion. The real power and planning happens elsewhere behind the scenes, and national government is reduced now to puppet status the world over. One world government is with us already, and this is no 'conspiracy theory'. As G. Edward Griffin (4) points out, “Very few major events of the past have occurred in the absence of conspiracies. To think that our modern age must be an exception is not rational.” (5) If we don't know this, then perhaps our own educations in history have been somewhat lacking?

The use of this term as ridicule of critics of the state is understandable as a good example of how what pass for our own thoughts are handed to us by the state. "Deception is a state of mind, and the mind of the state" (7) wrote James Angleton, Head of Counterintelligence at the CIA from 1954 to 1974 who was in a position to know I think. It is an indefensible and demonstrable nonsense to apply the term ‘conspiracy theory’ to what can be so easily demonstrated to be the case from the very architects themselves. Aldous Huxley knew what he was writing about in Brave New World, because his whole family were world controller class and intelligentsia. His Director of the Central London Hatchery and Conditioning Centre explains: "at last the child's mind is these suggestions, and the sum of the suggestions is the child's mind. And not the child's mind only. The adult's mind too-all his life long. The mind that judges and desires and decides - made up of these suggestions. But all these suggestions are our suggestions... Suggestions from the State." (7)

Julian Huxley, Aldous Huxley's older brother was the first director of UNESCO, the United Nations Educational, Scientific and Cultural Organisation. He wrote its mission statement in 1946 in which he said “in its educational programme it can stress the ultimate need for world political unity and familiarise all peoples with the implications of the transfer of full sovereignty from separate nations to a world organisation.” (8) (9)

It is not possible to reconcile this statement with fighting for king and country which was therefore a con, these being slated for obsolescence even as the war was being fought, and indeed long before that. The UN and its various agencies, through its 1,298 treaties (10) that national governments are signed up to implementing in domestic law, is, the global governance, and its founding documents, as above, and other sources reveal that this was always its mission. A not dissimilar ambition to Hitler's just defeated unification mission also, but such unification was never going to come about through military conquest. War did provide the excuse for implementing much the same agenda through peaceful means, and how we have come to understand the mission of the UN as world peacekeeper and thus feel such affiliation gratitude and reverence for it. It is not too cynical unfortunately to see the two World Wars of the twentieth century as the manufacture of a problem, justifying the solution (the UN), which turns out not to be what it seems at all, but merely similar world conquest ambition in disguise. Indeed the League of Nations formed after WW1 was the prototype of the UN and its 'International Commission on Intellectual Cooperation' which doesn't sound any less totalitarian in its implications was simply rebranded as UNESCO. WW2 therefore served to further advance a pre-existent covert agenda. It was as necessary for the success of the UN and its one world government agenda as 9/11 was necessary for the Patriot Act and the rest of the destruction of civil liberties in America and across the globe since then.

Still on the subject of state deception, and on a truly audacious scale scarcely grasped today, is the export to Britain and I expect other countries as well, I don't know, please tell me, of the American 'charter school' model of pretended local control over education. Charlotte Iserbyt, a one-time federal education department insider turned whistle blower is who you need to read in order to understand this new con. She has written a book entitled 'The Deliberate Dumbing Down of America' in which she accesses her impressive archive of documents she herself sneaked out the department in which the real agendas are revealed. Localism in all its forms in fact, not just in education is a con, masking its opposite, stronger centralised control. In England legislation is and has been going through at speed to put in place a new possibility amongst other things for dealing with the problem of people like us escaping. There is currently an intention to set up government-funded, free, private online courses aimed at home educators under this charter school movement. It has had the cheek to steal the name of the free schools it suppressed to give them that fake credential. It is to be hoped they would not get away with such an insult to Spain but how well do you know your own history? So while our government is distracting some of us, continuing the facade of pretending to be our friends and tinkering with guidelines documents, this runaway train is heading for us and set to take most of us out.

If you are not familiar with the story of the wild, free and fierce Okefenokee swamp pigs, which were lured by free grain as a fence was very slowly constructed around them that they were free to come and go through until they weren't, and were all taken to market, then this is easy to find online, and is a good metaphor I think for how the problem of Britain's escapees are to be rounded up, the easier to then persecute a much smaller number of refuseniks, and especially at a time when the government is robbing us and impoverishing us to an extent likely to make us hungry enough to go for their free grain.

To take another incredible example, a 2006 statutory instrument regulating school registration preserved the wording of the earlier instrument verbatim where it described the act of deregistration in such a way as lawyers understand it to mean that deregistration is immediate upon proper parental written notification of educating 'otherwise'. They added a section requiring the school to notify the LEA no later than the act of deregistration itself, in other words immediately, but then they stated in the accompanying guidance that a delay in deregistration was permissible in order to allow time for a letter to be sent to the LEA. This was at a time when a secure intranet was being set up between schools and the LEA so this was clearly an opportunistic nonsense, intended to give the LEA an opportunity to 'change the minds' of the intending home educator, but also to incrementally advance the principle of parental responsibility override, and there is no more fundamental principle to hang on to than the primacy of parental responsibility for education.

Through an additional and confusing addition to the original regulation that seemed to allow for the possibility of a delay, and the clear statement in guidance that this was indeed how it was to be understood, a lay understanding, and that means an LEA officers understanding also, was introduced which contradicted a barristers understanding of the new instrument, that deregistration remained as it was, immediate upon proper notification. The point I want to make is that the legislative body itself will not shrink from lying about what the law is, and the biggest lie about education throughout the world is that school is compulsory when mostly it is education that is. These duplicitous acts should be born in mind, if contemplating seeking legislation from government. If you can't do what Orwell called doublethink yourself, in order to anticipate what government will get out of what you want from it, then you had better not be talking to them at all for everyone’s sake.

Only the other day I read a journalist commenting in the thoughtful online 'Scottish Review' that he had personally witnessed “civil servants exquisitely craft sentences that have at least seven different meanings, ambiguity at its highest. And why do they do it? In order to keep as many interests on board as possible.” (12) I can certainly recognise that this is the way our government writes, although I may still be missing something in not being able to count as high as seven usually. Home educators in Britain are familiar with government guidelines documents and even statute itself which is written in this way to be all things to all people despite the unavoidability of embodying impossible contradictions in order to do so: 'doublethink'.
The global education system turns out to be designed from its inception to prevent true education, or at least bias it so grossly as to effectively rob us all of our own minds, through kindergarten to PHd. (13)

The institution of state compulsion schooling was born in its current form in the 18th century absolutist monarchies of Prussia and Austria to serve those totalitarian regimes which were failing in their control over the hearts and minds and bodies of its subject people largely through failing to successfully suppress literacy. (14, 15) The model it created was so successful that the world flocked to Prussia and brought it back to their own countries.

In Spain 100 years later at the turn of the 19th and twentieth centuries there was civil unrest in which the Catholic church schools which could be quite brutal, and the monarchy were equally hated, and precipitating revolt. Just as in Prussia and Austria a century earlier where 'the lower orders' were turning their backs on official schooling which did not teach literacy, and favouring instead their own 'back street schools' which did, so there was revolt in Spain against the 50 to 70 percent illiteracy then. Francisco Ferrer founded the first 'free school' which despite his own incarceration for a year without trial, and subsequent state murder without trial by firing squad, spawned a school movement that finds its few unsuppressed remnants today in the Sudbury Valley Schools in America, in Summerhill in England which our government recently unsuccessfully tried to shut down, and a handful of others dotted around the world.

Ferrer's free schools were schools in which children's own agendas were not banished, in which there was no compulsion, where the pupils and staff democratically ran the school, and if you punished a pupil it earned you permanent dismissal. In one account I read, I don't know if it was reliable, it was claimed that at their peak in the early twentieth century more children attended the free schools than the state schools.

All the above is by way of trying to paint a picture from history which might usefully inform us about now, because like 18th century Prussia and 19th century Spain, or England which maintained a paper tax known at the time as a knowledge tax, long after the introduction of state schooling, power was in trouble, and in danger of losing its grip fatally for it, and it is again today largely due to the ICT revolution rendering its old factory schooling system obsolete and an anachronism. The growing numbers of home educators discovering and exercising their suppressed freedoms is a symptom of that and a dangerous one potentially for power. This is why we are suddenly such an obsession for governments the world over.

As I understand it in Spain as in Britain, education is compulsory, but school is not, and the law in both countries does not thus limit how education is to happen, therefore this is our liberty, our freedom to choose, and this is also supposedly guaranteed in human rights legislation.

What we can see around the world in nearly every country, are basically one of two strategies operating to deal with this threat to absolutism - outright suppression, and integration. Both spell death to the self-owned and directed life where the learner is in charge of their own learning, and they are employed on a 'whatever works' basis depending on how established and assertive home educators are in a country. Integration of home education into the state education system is another form of death because as Gatto rhetorically asks in a question which formed the title of one of his early essays “Why fix a system designed to destroy individual thought?” (16)

Clearly it is impossible.

I came across a PHd thesis about home education and home educators the other day written by a non home educator who I had earlier locked horns with, which shocked me, and in which critics like me of government and the conscious or unconscious complicit meddling of academia were described in the words of Maggie Thatcher as 'the enemy within'! The thesis is not in the public domain so I can't give you a reference to it unfortunately, but it does illustrate how it is possible to get stabbed in the back by someone calling themselves a friend of home education in response to robust criticism of this person's work which was as unwanted to them as their interest in me was to me. I have never been called anything like that by any home educator, however strongly some have disagreed with me, and I have been known to a few hundred over many years. So beware of academia, it is part of the system whether those making their careers in it realise what they are part of or not, and it is clear from some of their writings that some are absolutely clueless of the part they are playing in the machine. Even the friendly ones may be bad news for us, and can act as a conduit by means of which our language may be harvested and debased by power in order to reinvent and pervert what we are about until it can be safely integrated into the system. It can be a true parrallel universe, when it comes to talking about who we are and what we do - the incomprehension and scholarly wrong assumptions simply staggering. If you haven't encountered Daniel Monk or Rob Reich they are prime examples of what I am talking about. Their projections of the faults of the system onto its victims are staggering to read. Academia is not a neutral institution. there are no neutral institutions and at best it is a two edged sword, be very careful how you use this part of the system.

Second talk

Law and Liberty

I am not a lawyer and have no legal training or qualifications, but like many home educators I have had to try to understand the law as it relates to our unwanted choice to home educate. Indeed it is widely recognised in the UK that home educators and not lawyers, even specialists in education law, may know the law better, and many solicitors have been successfully briefed by unqualified home educators.

In attempting to better understand the law in Spain and its different relationship of semi-autonomous regions to national government, and the relationship of national education law to regional education law, I found that my particular questions about this relationship, such questions as can the regions legally impose schooling, effectively banning home education when national law only prescribes education not schooling, were not being answered. I concluded that it was hopeless for me to attempt a good enough understanding of the legal landscape here, and that I had better confine my observations to general principles learned from our English experience and hope that they may be of some value. I also found myself wondering as I read, if Spanish home educators might still need to learn more about the law than seemed evident to me. What I can say is that until we were blessed with the wholehearted engagement of a home educating barrister in England, our knowledge of the law, while basically mostly correct, was perhaps also rudimentary in some respects, and certainly not as nuanced as it was enabled to become through this expert help.

The idea that home education, or anything for that matter, can be neither legal nor illegal seemed like an error to me, as does the idea of 'un vacuo legal', which I take to mean a legal vacuum, meaning the law is silent about the activity in question.

Where the law is silent about something, this is where our liberty resides. If something is not unlawful then it is by default lawful, and there is liberty to pursue the thing in any way one chooses so long as doing so does not break other laws as a consequence.

To take the English legal situation, parents are under a legal obligation to ensure 'suitable education' is 'received', and suitable is defined in the statute as 'efficient, full time' and 'suitable to age, ability, aptitude and any special educational needs'. This is to be ensured by means of 'regular attendance at school or otherwise'. Those wonderful two words 'or otherwise' are as far as the law goes, it does not go on to specify those other ways. So long as we meet the criteria of 'suitable', we can do what we like, and we do. The term 'home education' or anything similar meaning that, is not used in the statute, it is by default one possible legal means to meet the parental obligation to ensure suitable education is received.

Where the law does not regulate, neither can government nor local authority. It cannot lawfully fill that vacuum the phrase almost invites, and there can be no doubt that the activity is lawful if it is not proscribed in law. Welfare laws require parents to adequately feed and clothe and shelter their children, but they do not specify a diet, a minimum standard of clothing, or dwelling. So long as these don't appear to be insufficient to ensure the general welfare of the child, parents are left to get on with it. Despite school being the largest economic sector on earth, with all the vested interest and elite agendas determining it, school in most countries remains merely one of the ways to provide an education, that's all.

And that as I understand it is how matters should be in both our countries, with the choice left to parents who should only come to the attention of the authorities, if, in the words of the English statute, 'it appears that a child.....is not receiving a suitable education'. Only then are they put on enquiry for breach of the general law.

But sadly, we all know that in both our countries life is not as it should be, and the authorities tend to be far more intrusive than their powers lawfully allow, and that a fight through the courts, which is usually successful here I read, may be necessary to obtain the law. The problem would therefore seem to be essentially one of either simple ignorance of the law by local enforcement officers, or willful misunderstanding of the law, resulting in unlawful harassment of law abiding parents.

As I have previously argued, the institution of forced state schooling is built on lies and is vulnerable to exposure to the truth that it is not needed in order to produce productive well socialised adults. This is reason enough to explain its hostility. Forcing you to do what you don't want to do, or falsely imprisoning you is bullying, and the system therefore is a bully. It seems to me that it would be a grave mistake to effectively appease the bully by fudging the issue of whether it has the law on its side, where it does not, by asking it to specifically legislate to enable home education to be practiced. In England home educators simply asserted the right as a reasonable interpretation of the 'or otherwise' clause by showing that it met the 'suitable' criteria for an education.

There was an amusing incident in an early 1950s court case where an LEA was attempting to prosecute a home educator for not obeying their school attendance order and sending her children to school. The wretched jobsworth in the LEA as he was running out of arguments, complained bitterly that, 'parliament never envisaged a Mrs Baker, there has never been a Mrs Baker'. (1) Well it was probably true that parliament never intended the non-aristocracy to notice that there really can be one law for the rich and another for the rest but only if the rest can be kept ignorant of the law! Sadly fooling most of the people for most of their lives with a non-existent obligation to send ones child to school has been only too successful.

If the state is hostile to home education, which it is, because it sees it as a form of leakage or escape from its absolutist ambitions for the totally planned society, and if that state is a consummate deceiver with a hidden workforce/predictable consumer moulding agenda, which it is, then it is surely neither realistic to expect its regulation of home education not to be subverted to these system ends, nor to hope for further improvement once regulation has been obtained. Indeed gradualism or incrementalism, a process of slow social change that takes the long view and accepts two steps forward and one step back, the way outlined by the English Fabian society, which of course is now international like everything else, and the principle modus operandi of bringing about change, will be put to work by government in the opposite direction from the one we desire to go in. Don't give them the opportunity to get started on the destruction of this essential liberty wherever they haven't already usurped it.

State absolutism achieved in education is a truly frightening and evil thing. In Germany where this system was born in absolutism to more efficiently serve it, they have achieved that, and that country's state dictionary defines home education as child abuse, and no one knows any better, because there is almost no one who has not been schooled to be able to know from their own experience the truth of the matter. It is not only OK to snatch children from their beds in the middle of the night to foster them to strangers and not tell their loving parents where they are, it is their duty to do so to protect them from such parents. (2) Mass psychosis is my word for it.

Our experience of dealing with our own increasingly hostile government in England shows us that it is possible to defend the primary legislation that grants arguably good enough freedom, for now at least to successfully prevent the government from making us apply for licences to educate our children ourselves, which is what compulsory registration would mean. It is even possible to make the government admit in writing as it did in the last guidelines document it issued in 2007 ‘Local authorities have no statutory duties in relation to monitoring the quality of home education on a routine basis.'(3) This was a suggestion from us for a change!

So, if at all possible obtain from government, statements confirming the legality of home education, the nonexistence of statutory duties to monitor, or whatever, in preference to actually changing the law to say these things, because in the former scenario you still have your liberty under the law, plus this protection from local despotism of a government telling them what the law means. I suspect the suggestion from the Spanish constitutional court in 2010 to write enabling legislation for alternative ways to educate including home education, might come under Huxley's 'suggestions from the state'! If there is the possibility that the lack of proscription can be understood as liberty in this aspect of life, and a statement made by government to that effect, then this would be infinitely preferable to loss of that liberty.

The French political economist Frederic Bastiat (4) around 1850 stressed the importance of the law embodying justice, because without that it had no natural legitimacy. Justice should be the only business of law he maintained, but he also stressed that justice is achieved not by legislating for it, but by legislating to prevent injustice. Law he said should be negative, not positive, or by implication enabling. Under his system of law, if you can overlook the sin of coercing education in the first place, within that context in England we have negative law protecting our liberty, not regulation ensuring we comply by a system of licencing and inspections.

It only seems possible to lobby government either for what it already wants you to lobby it for, and has brainwashed us into doing, or if it is something that isn't wanted, but you are persistent enough, it will find ways to appear to give you what you want, or the hope of eventually getting it in order to keep 'government by consent' going. Only for as long as it can keep you talking can it claim its fake democratic listening credentials, so if there is to be talk make that talk count for something, not just treading water. Only the government benefits from that as it continues to advance against you on other fronts. Distraction burglary is one of their ways.

Credibly threaten to break off talks that are going nowhere, or refuse cosy chats in their corridors of power that have no clear purpose or prior shared agenda. Let them know there is a line they can cross that if they cross it, then they risk losing this constituency and their faked appearance of listening which is so important to them. Be aware for eg. that consultations are not consultations at all, they are SATS, standard assessment tests to determine how well or how poorly we have understood what it wants us on board with, and provides them therefore with useful intelligence as to any problems the prior agenda may run into, and how best to spin the PR. With this in mind it is none the less possible to respond to their rigged exercise on your own terms. Colluding with trying to make a silk purse out of their sows ear, to use an English expression is doomed to failure as the original agenda gains its appearance of consent thereby. Destructively testing their love, is better than imagining we have to be 'good' to avoid being punished. That's just a projection from unhappy childhood.

It is three decades since the Westminster government first expressed a desire to force home educators to register with local government. They tried to sneak through withholding de-registration from schools only this year, hoping we wouldn't notice, and then dropped it like a hot potato the minute they got caught. It was almost comical.

Despite such telling behaviours our common fear is that they will just bulldoze something unwanted through regardless of our feelings about it, but brute force, direct head on confrontation like that never seems to get closer than threat, and had they succeeded they must have known that they would be pushing us too far and into civil disobedience territory. Such acts of domestic terrorism by our own government upon us serve they hope to make us grateful for lesser attrition, but we do not have to be so manipulable.

Withdrawing consent then would seem like a way to neutralise the preferred modus operandi of government which is to keep you on board, while tricking you into believing you might be getting somewhere in obtaining what you want. Find ways to say no to it that you personally feel able to do. Easier said than done I know, but just saying it on publically accessible forums will rattle them, and even provide good entertainment sometimes in their response, which is another story I don't have time for now! They do not want their games exposed.

A change of intolerable scoundrels every five years serves to keep the illusions of democracy going while the real agenda, along with the new despots, con artists and honest dupes enjoys a honeymoon period as it carries on without a pause. Had the new legislation in 2010 succeeded then it would almost certainly have moved into the territory of open defiance of the measures, such as Australian home educators demonstrate by recognising that there is the 'permissive' and 'non permissive' routes into home education.

In Australia breaking the law has a recognised name for a choice! (3) In Queensland alone between 7,000 and 11,000 children are home educated by otherwise law abiding people who will not stomach this imposition because they know it is wrong. A dangerous precedent for any government to set surely, educating its citizens on the limits to its own power.

Government seeks legitimacy and consent and this is so deeply embedded now in the modus operandi of modern government that it will go to extraordinary lengths, including removing hated impositions like the children's database or ID cards in England in order not to suffer widespread civil disobedience. We are far from being as powerless as the monolith of government would like us to believe is the case.

Negotiating with government is never legitimate if it results in negotiating away liberties, because they are not yours to concede and belong to everyone and to future generations. You will be rightly hated and vilified if you do this, and what is more you will have yourself become part of illegitimate government. Pragmatic ideas of 'this is the best we can get' may or may not be self-fulfilling prophesies. If your approach is of this fatalistic kind, and this is fatalism, then this is what you will get and so will our children and their children, and they might not thank you for it.

We are not in the enviable position of being able to choose a safe and easy way to protect our children from such an exploitative and abusive system. There are also obvious limits to the potential for direct civil disobedience if it empowers state kidnap of our children by way of response, but that does not mean we are powerless and can do nothing because of this exploitable vulnerability. While the law remains on our side where it does, it is vital to keep it that way and law breaking authorities and government itself can be called to account for its law-breaking and misrepresentation. Better to be on the right side of good enough law, and the authorities on the wrong side of it, than to end up on the wrong side of bad law. No one wants to have to fight in order to enjoy liberty of course, but there is a much worse scenario.

Fahrenheit 451. La cosa está que arde...

La distopía no resulta lejana. Educar en casa parece ser para la estructura institucional estatal (política, legislativa y judicial -y a pesar de la diversidad interautonómica-), como tener un libro en la novela de Ray Bradbury (1953): motivo de censura y actuación radical de alguna “santa” inquisición.

La lectura de la novela de Bradbury resulta no sólo entretenida, sino tenebrosa. Fugaz como un chaparrón y con la misma capacidad de dejarte calado hasta los huesos. Vamos, no tiene desperdicio.

Y para el caso que nos ocupa a las familias que hemos optado por la vía de responsabilizarnos de la educación (social, ética, personal, instructiva...) de nuestros hijos e hijas, puede resultar una paralela descripción de la realidad en que vivimos. Que podría dramatizarse aún más si las señales que nos llegan de endurecimiento de la vía judicial contra la educación en casa fraguan y se consolidan.

De todos modos, como en la novela, la Humanidad es sabia, como lo somos quienes educamos en casa -sólo por ser parte de la Humanidad, no porque tengamos nada de especial- y no dejamos de tener libros en casa e incluso leerlos. O sea, no dejamos de seguir adelante con lo que creemos que será mejor para nuestros/as hijos/as, para nosotros/as mismos/as y para la sociedad en que vivimos (beneficios a muy distintos niveles, directos e indirectos, evidentes e insospechados, éticos, económicos, de desarrollo personal y humano...).

Cada día somos más, más conscientes y organizados. Dentro y sobre todo fuera de España, así que nos toca abrir las ventanas y las puertas para que la corriente se lleve la podredumbre y el frescor lo indunde todo.

A Alonso Quijano ya le quemaba los libros Cervantes -si bien puede que sólo para alimentar la quema de consciencias retrógradas-, ¿quién quiere quemar “los nuestros”? ¿Vamos a ver cómo arden sin hacer nada?

It is a privilege to be here with you in Spain - a country that has contributed so much to our world. Indeed, it may not be the best measure, but there has to be something very special about a culture whose language ranks among the top 5 or so spoken in the world. As I flew over and travelled by train from Barcelona I enjoyed the beautiful scenery of the coast. And of course I congratulate you on your well-earned world cup victory. After the US was eliminated by Ghana I was rooting for Spain and I marveled at the elegant style of play of the Spanish team. If I had to name a favorite team outside the United States where I cheer for DC United I would have to pick Real Madrid. But I digress – I am not here to talk about sports with you. Rather I bring you greetings from your fellow homeschoolers in America where the number of students is over 2 million which translates into perhaps 750,000 families. This represents about 3-4% of the school age population. In America, homeschooling is a growing and main stream form of education for children. Today all 50 states have laws, regulations or court decisions that explicitly recognize parent’s rights to homeschool. However, homeschooling in America, like much of the world today has not always been as free and accepted as it is today.

And in the United States compared to many countries we have a relatively higher degree of freedom from government oversight and control – at least in some of our states. As a federal republic the individual states of our country are responsible for their own educational laws. In nearly 20% of the states there is no government oversight whatsoever. In most of the rest the only form of government contact required is simple notification. In just under half of the states is some form of assessment required.

Our association was started in order to defend parents in trouble and to advocate for greater freedom for homeschooling. Since 1983 we have been working in courts of law, in national and state legislatures, in the media, with universities and colleges, government agencies, and at the international level as advocates for home schooling. We were founded on the basic premise, one that was acknowledged by our own supreme court - that is that parents have a fundamental right to direct the education of their children. I believe with my whole heart that families are the fundamental building block of society and that parents have a natural right which must be protected to raise their children according to their convictions. For me this fight is personal – I believe that children are a gift from God who puts children in a family for their good and as blessings to parents. My wife and I homeschool our seven children so I have a personal appreciation of the love you show for your children by accepting the challenges and sacrifices that comes with homeschooling. Of course the benefits far outweigh the costs but we must acknowledge the sacrifices parents make to teach their own children at home – especially the moms since they do the majority of the work in most cases..

It should come as no surprise that parents who seek to homeschool their children are treated with suspicion or even hostility. This happened frequently and was the norm during the early years of homeschooling in America. During the 70s, 80s and even 90s’ parents received similar treatment as homeschoolers in countries like Germany, Sweden, and now apparently Spain. During our fight to legalize homeschooling, American parents were fined, threatened with jail, threatened with the custody of their children, and some cases actually did serve prison sentences for homeschooling the children and lose their children to state custody. These controversies expose the underlying conflict between competing views of the relationship between families and the State in the area of education.

But where does this resistance come from? And why should such difficult obstacles exists if the right of parents to direct their children's education is acknowledged as a fundamental human right? Well first – many people don’t want parents to educate their children, they believe it is the state’s responsibility to do it. And secondly – when you suggest that homeschooling or even just parental freedom to choose the child’s form of education which should include homeschooling – some people look at you like you’re from another planet.

I was in Frankfurt Germany last night where I presented at a Global conference on the philosophy of law and social philosophy. For the first time this conference included homeschooling as a human right – this was my argument. But there are many in government and in the professional educational establishment who believe that it is the State’s role to influence and shape society have no choice but to argue that the State must take a leading role in educating children. After all, children are the future of the society and of the State. Indeed, if the State is responsible for education or has a significant interest therein, then it must have broad authority by which to prescribe the method, mechanism, and acceptable outcomes of education; it must also be able to review and enforce these desired outcomes. This is a dangerous and fairly recent view of education that has had tragic consequence during some of the most troubling periods of the last century. However, if parents, on the other hand, are primarily responsible for a child’s education then it is the State’s duty to defer to parents absent a compelling reason to interfere.

This controversy over freedom in education for parents is particularly reflected in homeschooling where parental influence is at its height - a scary thing to those who are seeking to remake society in a new image. For some every child has not only a right to education but in their opinion they must receive a state-approved and state-funded educational experience. This, they argue, is vital to the transmission of “national values” and to ensure that every child is educated and safeguarded by trained professionals.

Dr. Charles Glenn and Dr. Jan de Groof are education professors at leading universities in the United States and Netherlands. They have written an encyclopedia about education policy in 40 countries. In their books they write that “to deny choice for parents to determine where and how their children are educated is unjust and unworthy of a free society.”^{^[2]} Not only is it unjust - it is also contrary to accepted norms of current international human rights doctrine. All of the primary and foundational international human rights documents recognize that the right of parents to control and direct their children’s education is a tenet of human rights doctrine and is not only recognized but is superior in relation to the claims of the State in educating children.

Let’s look at some of these documents:

Article 26, part 3, of The Universal Declaration of Human Rights of 1948 states that “parents have a prior right to choose the kind of education that shall be given to their children” (emphasis added). The fact that the word “prior” is used is indicative of the hierarchy and primacy of the right of parents in relation to the State.

The 1950 European Convention for the Protection of Human Rights and Fundamental Freedoms provides in Article 2 that,

in the exercise of any functions which it assumes in relation to education and teaching, the State shall respect the right of parents to ensure such education and teaching in conformity with their own religious and philosophical convictions.

In 1966, the UN General Assembly opened the International Covenant on Economic, Social and Cultural Rights for signature. The covenant entered into force in 1976. Article 13.3 states:

the States Parties to the present covenant undertake to have respect for the liberty of parents […] to choose for their children schools, other than those established by public authorities, which conform to such minimum educational standards as may be laid down or approved by the State and to ensure that religious or moral education of their children is in conformity with their own convictions.

Even though this covenant allows the State to create certain “minimum educational standards”, it reaffirms the Declaration’s recognition of parents’ rights. That same year, the International Covenant on Civil and Political Rights went into effect, providing in Article 18, paragraph 4 that:

The States Parties to the present Covenant undertake to have respect for the liberty of parents and, when applicable, legal guardians to ensure the religious and moral education of their children in conformity with their own convictions.

Without quibbling over or parsing what it means to “ensure . . . education in conformity with their own convictions,” it seems eminently clear, as a foundational principle, that the right of parents to direct their children’s education is considered a human right that must be respected by States professing an allegiance to the human rights set forth in these documents.

Well if this is true then why is educational freedom not supported by progressives when other human rights, such as the freedoms of speech, the press, religious belief, and voluntary association” are supported?^{^[3]} Why do these progressive elites “see family as a source of resistance to social progress and put their trust in government-sponsored schooling to make children more progressive and more enlightened than their parents”?^{^[4]} Why are there countries like Germany, Sweden, Brazil, and the Canadian province of Quebec, among others, that claim to respect general human rights norms and yet ban or oppress homeschooling parents? What is it that makes the education of a child is so controversial? Why should there be such a struggle between parents and governments over how, what, when, and where a child learns?

Perhaps Emory University School of Law Professor Martha Albertson-Fineman makes the argument for this point of view best when she writes: "The appropriate suggestion for our current educational dilemma is that public education should be mandatory and universal. Parental interest can supplement but never replace the public institutions where the basic and fundamental lesson should be taught and experienced by all American children which is this - that we must struggle together to define ourselves both as a collective and as individuals.^{^[5]}(emphasis added)

Apparently it is not enough that children have the opportunity to experience a state-funded and state-controlled education; homeschooling and private schools must be banned so that all children go to public schools. This view has its roots in the philosophy of Jean Jacques Rousseau a French social contract philosopher who believed that the state must control education. Rousseau, on the other hand, viewed the State as the supreme authority with respect to children. He firmly understood the importance of education and its role in shaping society. It was necessary, he thought, to compel parents to give up their children to receive an education that reflected the enlightenment values of the impending French Revolution. The State, in Rousseau’s world, must control education.

For Rousseau, the State was the stabilizing force in society and thus had to take control of the education of children in order to enable them--and the State--to fulfill their ultimate potential. Revolutionaries maintained that parents would have to give way in order for France to discard the monarchy for republican values.

“From the first moment of life, men ought to begin learning to deserve to live; and, as at the instant of birth we partake of the rights of citizenship, that instant ought to be the beginning of the exercise of our duty. If there are laws for the age of maturity, there ought to be laws for infancy, teaching obedience to others: and as the reason of each man is not left to be the sole arbiter of his duties, government ought the less indiscriminately to abandon to the intelligence and prejudices of fathers the education of their children, as that education is of still greater importance to the State than to the fathers: for, according to the course of nature, the death of the father often deprives him of the final fruits of education; but his country sooner or later perceives its effects. Families dissolve but the State remains.”

This philosophy stands in stark contrast with that of John Locke the English philosopher who believe that the government had no role whatsoever in the education of children. Lock believed that nature granted instructions solely to parental power, not the civil government. And it is interesting to observe how in England today the law reflects this philosophy by granting great freedom to British citizens to homeschool without oversight or intervention from the British government whereas in France homeschooling is legal but is highly regulated and overseen by inspectors from the national education establishment.

Of course we all know that the most tragic application of this philosophy that it is the state's role to shape society and therefore educate children as the future of society was in Germany during the 1930s and 1940s when Adolph Hitler nationalized the education system and criminalized parents who did not send their children to the public schools. For Hitler the "youth of today are the people of tomorrow". He knew that if he got the children he got the culture. He said this "When an opponent declares, “I will not come over to your side,” I calmly say, “your child belongs to us already... What are you? You will pass on. Your descendants, however, now stand in the new camp. In a short time they will know nothing else but this new community.”

Incredibly echoes of these ideas remain in Germany today where public policy makers and judges stubbornly refuse to permit parents to homeschool their children.

In 2003, the German court system reviewed a case of a German family who wished to homeschool their children. The family was denied an exception to the compulsory school law by local education authorities and received a civil fine. The family appealed the fine to the German Constitutional Court which upon review wrote that the “general public has a justified interest in counteracting the development of religiously or philosophically motivated ‘parallel societies’ and in integrating minorities in this area.”^{^[6]} Despite the assertion to the contrary in the United Nations’ Universal Declaration of Human Rights, the German court said that parents do not have a prior right, but rather share an equal claim with the State in the education of children:

Social confidence in dealing with people who have different opinions, lived tolerance, the ability to assert oneself and the assertion of a conviction that differs from that of a majority opinion can be practiced more effectively if context was society and with the various views represented in society do not take place only occasionally, but rather are part of the everyday experience associated with regular school attendance.^{^[7]}

This is frightening language from a country with Germany’s history. What is perhaps just as frightening is the result of an appeal from a German case to the European Court of Human Rights in 2006. In this case, the Konrad case, the Court denied the family’s application stating that Germany was within its “margin of appreciation” to ban homeschooling. In reviewing the case, the Court noted that the German position--that the State had an interest equal to the parents in the education of children--was not a problem. The Court stated that refusing to hear the case was “justified under Article 8 § 2 and Article 9 § 2 respectively as being provided for by law and necessary in a democratic society and in the public interest of securing the education of the child.”^{^[8]} The court rejected the Konrads’ application as “manifestly ill-founded.” I do understand that the religious overtones in this case was probably a bit too much for the German and European Judges. But in a similar case in the United States the Romeike Family was granted political asylum because of the way Germany treats homeschoolers as a social group.

We see this attitude in other countries also.

Real Life Examples of Homeschoolers Being Threatened

Here are some examples:

Spain: The Sala-González family of Alicante, Spain faces a September 9 court date over homeschooling, despite the fact that social workers in the case have reported favorably on the family. Spanish prosecutors insist that the family is breaking the law by educating their child at home. Since December 2010, when a vague ruling from Spain’s Constitutional Court put families in a legal limbo, more Spanish homeschool families are facing trouble with social workers and education authorities. Although homeschooling is not explicitly prohibited, officials also argue that homeschooling is not explicitly permitted by their compulsory attendance laws. This is not an isolated situation in Spain but rather an increasingly common one.

Germany - I have been working on behalf of freedom for German homeschoolers for five years. There have been countless cases of homeschooling parents in Germany threatened with court action including imprisonment, crushing fines, and even with the loss of custody of their children. I have been on the phone with parents who have had to fully with only hours notice from Germany to other countries. The situation continues.

Sweden: in Sweden, a country known for its "social utopia", officials from the island community of Gotland took Dominic Johnson from his parents. The family were on board a jet liner moments before takeoff as the family was moving to the mother's home country of India. It has been over two years and since November the family has not seen Dominic once. How can you describe this as anything but psychological torture? Last year, the Swedish Parliament passed a law that permitted homeschooling only under extraordinary circumstances and made it possible for parents to be criminally prosecuted. Homeschooling families from Sweden are now having to leave the country in some cases under the pressure from social services investigations.

I could literally go on for hours talking about the cases and situations around the world where homeschoolers have been repressed, isolated, persecuted and harassed by their government.

It is this statist philosophy, specifically the Nazi philosophy that led directly to the Universal declaration of human rights in 1945. As a global community nations recognized the need to establish certain baseline standards for the treatment of humanity. And among these was the right of parents to choose freely and without state interference the form of education for their children.

Today we are gathered here in Spain, the largest such gathering in the history of the modern Spanish homeschooling movement – good for you! Here we are gathered as a group of parents who believe in the freedom of education and that all children should have a right to be homeschooled - that parents should be able to decide to homeschool their children without unreasonable interference from the government.

Around the world more and more parents want to homeschool their children. They are dissatisfied with all of the other alternatives and, perhaps more important, they want their children to enjoy the benefits that homeschooling provides.

Different Countries Same Objections

However, all of us – even in America where homeschooling is quite accepted and free homeschoolers are confronted with difficult challenges. These challenges come from government officials and their fellow citizens. As I have traveled internationally and met with many homeschoolers, public policy makers, and members of the media and press I have found that regardless of the country or the context the objections to homeschooling remain virtually the same.

These three objections focus on “academic outcomes”, “teacher competency” and “socialization.”

Academic outcomes has to do with what, how much and how well children learn. Never mind that public schools are failing in this area – we won’t get caught up in comparisons. “Teacher competency” essentially says that mothers (who, in nearly all cases, do the teaching at home) are not qualified to teach their children. How, the question goes, could a mere mother who has no specialized training in education or even a college degree in many cases possibly match the educational outcomes that supposedly come from the teaching of a college-educated, trained and state-certified public school teacher? “Socialization” is usually couched in terms of the need for children to go to school with children their own age in order to learn how to “get along.” This objection comes with a related objection about the lack of oversight and potential for undetected physical abuse or neglect of homeschooled children who are “off the radar” - meaning that because they don't go to school “no one” sees them.

As homeschooling grew in America education professionals observed the fast growth of the homeschooling movement concern and shock. Here is what some of the leaders in the educational establishment said about the homeschooling movement in America over the years.

National Education Association’s Robert McClure said that “it’s important for children to move outside their families and learn how to function with strangers,” expressing fear that home education would undermine commitment to American pluralism.^{^[9]} Omar Norton of the Maine Department of Education stated that “instruction in isolation cannot compare with a child being educated in a group.” Texas Federation of Teachers President John Cole observed that “if anyone can teach, teaching will, indeed, no longer be a profession.”^{^[10]} Donald Venus, a supervisor of public instruction in Michigan, put it this way: “If you need a license to cut hair, then you should have one to mold a kid’s mind.”^{^[11]}

Education professionals were not alone. When asked in a Gallup survey whether homeschooling was a good or bad thing, only 16% of the American public in 1985 said that it was good. That number rose to 41% in 2001. Today I would say that number is well over 60% perhaps as high as 75% - However, as the 16% in 1985 illustrates, not many people were enthusiastic about homeschooling in the early years.^{^[12]}

How did this change in perception occur? How were we in the United States able to overcome these objections – mostly the same ones that virtually all homeschoolers all over the world have to deal with?

We overcame these objections with facts, evidence and convincing argumentation. It didn’t happen overnight – in fact it took a really long time. My hope is that you will be able to benefit from our experience and that public policy makers in some countries will be willing to examine the American experience with homeschooling in order to come to the same conclusion that all of our states came to – that homeschooling ought to be allowed. I know that some European policy makers are quite stuck up when it comes to looking at the United States. And of course every country is different and has its own culture and of course must solve its own problems within its own people. But are American children so different from Spanish or Bulgarian or Russian children that general findings are irrelevant? I don’t think so.

Research Results are in Academic Performance and Social Competency

After 30-plus years of increasing experience, scientific research is providing strong evidence exposing the flaws in these criticisms. Research conducted by Dr. Brian Ray has consistently shown that academic outcomes are not significantly related to the training or educational status of the teacher. Dr. Robert Kunzman is a professor of education at Indiana University and specializes in researching the homeschooling movement. He says that more than fifteen hundred articles have been written since 1919 about homeschooling, most of them since 1975.^{^[13]} with nearly 200 written on the academic performance of homeschooled students. These studies address the issue of academic performance. Several researchers have surveyed tens of thousands of homeschooled students dating back to 1990. These works include a study by Dr. Brian Ray and Dr. Lawrence Rudman and show that homeschooled students’ academic performance on standardized tests are generally as much as 25 to 35 percentile points higher than the average public school students’.^{^[14]} These reports can be accessed at the Home School Legal Defense Association’s website (www.hslda.org/research). The studies have found that there is no or only minimal correlation between a homeschool teacher’s credentials or qualifications and the academic performance of the child. Essentially, this meant that a homeschooling mother who did not have a high school diploma and any homeschooling mother who had a Ph.D. would, on average, achieve similar results. Students taught by both were 25 to 35 percentile points higher than the national average representing public school students.

Dr. Kunzman also reports that over 220 articles have been written regarding socialization of homeschooled students since 1984. One 2003 study by Dr. Ray surveyed nearly five thousand homeschool graduates. In “Home Educated and Now Adults” Dr. Ray found that homeschooled students were more civically active and participated in more extracurricular activities than the average public school student.^{^[15]} Dr. Ray’s research shows that homeschooled children go to college, enter the workforce, become active in politics and are highly involved in their communities at rates equal to or higher than their peers in other educational settings. Another study performed by Dr. David J. Francis and Dr. Timothy Keefe, published in 2004, found that the social skills and competencies of homeschooled children as measured on standardized tests were as good or better than public school children.^{^[16]} Dr. Richard Medlin offers the most recent synthesis of research on the social, emotional, and psychological development of the home educated. In his work Dr. Medlin found that home educated students are active and well-adjusted.^{^[17]} These findings make sense when one looks below the surface to see how homeschooling works.

In homeschooling, children are not tied to a set schedule or physical brick-and-mortar location. Homeschooling is in many cases as much a lifestyle as it is a form of education. It allows for far greater flexibility for children to follow their own interests—to a much greater extent than most public school children are able to do. News reports frequently highlight homeschooled students who have made notable accomplishments in large part because they were not tied to a traditional educational setting. For example, in July 2009, homeschooled teenager Zac Sunderland became the youngest person to circumnavigate the world. Actor Will Smith and his wife Jade explained to Essence magazine that they homeschool their children because it allows “for flexibility so they can stay with us when we travel and also because the school system in this country—public and private—is designed for the industrial age. We’re in the technological age. We don’t want our kids to memorize. We want them to learn.”^{^[18]} Homeschoolers have also won a disproportionate number of national science, math, spelling, geography, and other academic competitions.^{^[19]}

Solutions

So these are the basic challenges. They are not small and they make take years to overcome. In countries where homeschooling is just getting started it is easy for people to feel isolated and alone and that they should just give up. But there is no need for this especially when as a global movement with much in common we can support one another.

I can tell you that our 82,000 member families care about you. They care about your families and about your movement. We have been helping families all over the world who are in trouble. Why you may ask – why does an American organization care about homeschoolers around the world. Well first of all you know how we Americans just can’t keep our nose out of other people’s business. After a couple of hundred years of keeping to ourselves we now just can’t mind our own business. J But seriously - it is part of our associations mission to advance the cause of homeschooling. More than just altruism which for me is certainly sufficient reason, there is a pragmatic rationale for why American homeschoolers should care what happens to their comrades overseas.

Ideas travel very quickly over the Internet. And these notions that homeschooling is dangerous or should be restricted must be resisted wherever and whenever they appear. So if we let the German and Swedish authorities get away with persecuting homeschoolers authorities in our country over time might try to use their arguments as reason to further regulate us. After all the German school system was a model that the early education professionals in America used to develop our education system.

More than this however is that we have been blessed with great freedom and resources in our country. And we believe that it is our duty to help those who are oppressed, the inscription under the statute of liberty in our country, given to us by our French compatriots says “Give us your poor, your tired, your huddled masses, yearning to breathe free”. America homeschoolers know what it is like to suffer because of homeschooling. And we know that it helps to have support.

In the United States, homeschoolers have been able to change public perception by engaging in the Democratic legislative process to change laws but have also engaged in the public debate through the media. If we work together we can make a difference in countries where homeschooling is just getting started. While America may have the largest population with greater resources, we cannot and should not do it alone. Because It makes a difference when homeschoolers from all over the world get involved - it shows that it is not just those troublesome meddling Americans. Even If only to provide moral support and encouragement to the few homeschoolers. But our experience suggests that international contact does help.

For example, in February 2011, letters from HSLDA members and supporters of homeschooling around the world made a difference in the lives of the Vitoria-Gasteiz family convincing the court to drop charges of educational neglect against a Spanish homeschool family.

ALE brought this family’s situation to our attention and we worked together to encourage homeschoolers in Spain and elsewhere to write to the judge who would hear their case.

“The support from around the world made all the difference,” ALE representative Daragh McInerney told HSLDA. “It showed the court that homeschooling is simply another educational option, not a dereliction of one’s parental duties.”

“The local court has asked us to spread the word that the family’s case is over, so they will stop receiving letters and faxes—hundreds have arrived,” says McInerney. “Hopefully there will be more good news on the way soon for other families facing legal proceedings.”

In this experience has been repeated in other countries like Botswana, Sweden, Germany, Russia, England and elsewhere. Public policy makers and government officials are simply unaware about the facts of homeschooling. These individuals have been brought up in an environment which assumes that the state should be and is virtually all-powerful and that it is a matter of course that children must go to the public school. By providing arguments and information against the objections to homeschooling I have described above both in specific cases and in general we are able to help individual homeschooling families and homeschooling as a movement in all of our countries. By pointing out that Freedom in education is and ought to be treated as a fundamental human right we build a stronger foundation for freedom for all of us all over the world. By fighting threats to freedom especially in western democracies like Sweden and Germany and Spain, we can develop the ability to defend others while helping our own cause.

This is fairly easy for us to do. We have sponsored and published research, written letters to members of parliaments, to minsters of education, to ambassadors, we have helped support legal cases – some have lost but some have won. We have helped families flee oppression. We would like to be an encouragement to others because we know what a difference it makes to know that there are people out there thinking of you, praying for you and fighting for you. We can do these things, but ultimately success in each of our countries can only be achieved within each country’s political system. This success requires patience and persistence. You have keep going back to policy makers with the same arguments., to the media. To your neighbors. You have to be tireless and gracious. But if you will do this I’m confident that you will be successful. One of the founders of our country, Samuel Adams once said that it does not take a majority to prevail but only a tireless minority willing to constantly set brushfires in the minds of their neighbors. This is what homeschoolers everywhere must do. And there is one thing that is certain of course, that if you give up you will never succeed, but if you never give up, you can’t help but succeeding.

Reuniones locales abiertas de Educación Sin Escuela

El fin de semana del 22 y 23 de octubre, se van a celebrar reuniones locales abiertas sobre la Educación Sin Escuela, estas reuniones están abiertas a todos los que Educamos Sin Escuela, no solo a los socios de ALE y en ellas vamos a debatir las líneas a seguir para defender nuestra posición educativa en España.

También hemos organizado dos reuniones virtuales en el chat del foro de ALE:

Una para el sábado 15 de octubre a las 11:00h de la mañana, donde podremos preguntar y conversar con el presidente de ALE, Daragh Mcinerney, sobre las reuniones locales, la situación actual y otros temas pertinentes.
Y otra para el lunes 17 de octubre a las 21:00h, donde el responsable del equipo legal de ALE, Sergio Saavedra, nos contará el trabajo que estamos haciendo en ese sentido y responderá a todas vuestras preguntas.

Si eres de ALE, podrás participar en el chat con el usuario del foro, si no eres de ALE y quieres participar, manda un email a admin@educacionlibre.org y te mandaremos un usuario temporal para que puedas participar, tanto el sábado con el lunes.

Ideas para los reuniones locales

Hasta el momento, ya hay reuniones convocadas en 7 puntos de España para el fin de semana del 22 al 23 de Octubre, y esperamos que la convocatoria se extienda. Poneos por favor en contacto con todas aquellas personas que conozcáis que eduquen al margen de la escuela oficial en vuestra provincia o comunidad, para quedar e intercambiar opiniones y pareceres. Ofrecemos a continuación algunas ideas para tratar en las reuniones locales:

La gran pregunta: ¿Cómo se pueden solucionar los problemas que tienen las familias que quieren sacar a sus hijos del colegio sin un proceso judicial?¿Cómo afrontar la clara discriminación que sufrimos quienes desescolarizamos a la hora de acceder a la obtención de títulos? ¿Cómo actuar en ausencia de una regulación que respetase las diferencias existentes y suficientemente documentadas entre la educación recibida fuera de la escuela oficial y la impartida por dicho sistema escolar?

Las dos corrientes más visibles al respecto son: o pelear como colectivo para ganar los juicios que se van produciendo, contactando con los defensores del pueblo, difundiendo nuestra opción y ofreciéndonos apoyo mutuo, a la espera de una sociedad más preparada para aceptar nuestro ejercicio de libertad, o bien buscar de forma más agresiva el reconocimiento legislativo, contactando con las autoridades para reducir los problemas legales, difundir nuestra visión de las cosas, ofrecernos apoyo mutuo, y aceptar que vale la pena intentar conseguir la regulación, aún en el caso de que ésta fuera algo más restrictiva de lo deseado por algunos, pero que solventaría la incertidumbre actual.

En las reuniones sería bueno aclarar los matices de estas dos posturas, y hablar libremente sobre los pareceres e inquietudes de cada cual sobre las líneas de actuación que podemos tomar. Existen maneras de estar activos mientras debatimos: trabajar con nuestros contactos internacionales para tener la mejor información y respaldo posible, desarrollar y presentar un documento sobre los beneficios y la legalidad de la <> a los Servicios Sociales y Consejerías de Educación en cada Comunidad Autónoma, e incluso en cada colegio si tenemos los recursos necesarios en un intento de frenar los problemas, y, el más importante, que nos ocupa ahora, juntarnos para tener la mejor visión global de nuestra situación. La comunicación y el intercambio de opiniones y sus contrastes nos ayudarán a tener más claridad y ver cuáles son los pasos que podemos tomar en cada momento, de forma que todos estemos incluidos y todos seamos respetados.

My experience with home education

I have been home educating three of my five children for 9 years. They all went to school first. Two of my sons started with home education when they were 14 and 11 years old. The youngest left school two years later with 10. We were in conflict with the authorities for five years. We got fined twice and at the end of this time we were tired of this hopeless struggle although we won some victories. My fourth child wrote to the authorities by himself one year after he left school. He got invited to the president of the school authorities (second level). The president was very impressed by him and she offered him the possibility to learn at home if he agreed to be tested once a year at the school authorities. He accepted the offer. Shortly after this the president changed and the next one was much stricter. He didn’t extend this agreement to our two other sons.

After these five years we decided to leave Germany for a while and moved to England. Home education wasn’t the only reason, we already had played with the thought of moving into another country for quite a while. So it was just a kick to do it then.

We enjoyed the time in England. We didn’t have to argue for our decision to home educate our sons, which we had to do in Germany all the time. In Germany we noticed that this topic got a lot of people in rage when we told them about it. But this has changed since then.

We also enjoyed not being the only family in the wider area. We enjoyed being members of several home education groups and we loved the gatherings and events. This experience was a big gift for us and we still have contacts to our friends over there.

We moved back to Germany nearly three years ago because of family reasons. Although our youngest son was still of school age, we didn’t get into trouble with the authorities any more. All our sons did one of the German exams as private candidates. Our youngest son went back to England last year and started studying agriculture at college.

Funny enough, it is possible to takethe three different levels of graduation exams in Germany as a private candidate without being in school.

Two years ago I started working for Clonlara school and now I am running the German Clonlara home based education program. I am in contact with lots of home educating families - not only via Clonlara. Clonlara supports families individually – helps them making an individual curriculum, with the documentation of the learning process and writing reports about the learning process at the end of the year. Some of the enrolled families did get their home education accepted because of those reports which we did send to them.

The legal situation in Germany

In Germany the school laws are made by the federal states. Most of those state school laws would allow the possibility to educate ones children in another way. But the interpretation of these paragraphs is much stricter than it is written. School authorities and courts say that these other ways are only allowed if the child is so ill that visiting a school is not possible. Although this interpretation is supported by school authorities and most of the judges, there are still families where home education is tolerated by their local authorities. I already noticed during our own conflict, that not all the people working for the school authorities or the social services think in the same strict way. There are a lot who are aware of the bad situation at most schools and they think that home education might be a positive alternative for children or at least some children. If families have someone like this as a contact person then there could be a way of acceptance. But the families normally have to be very quiet about the home education.

What can happen to the families if the contact person doesn’t tolerate their home education?

Families can get fined. Fines depend on the income of the family and can be from 50 Euros to 1000 or sometimes 1500 Euros. If a family continues to home educate and the authorities assume that they will just pay the fine and go on with this practice, then they can get a coercive fine (fine in advance). This can be a lot more, 5000 Euros is common for this. And families can get this again after some weeks or some months. There are two federal states, where not sending children to school is not only a minor breach of the law (administrative offence) but a criminal act. But it is not common to send parents to jail for this. Most of the cases when parents had to go to jail, home education is not the main reason. They are sent to jail because they didn’t pay their fines. And they didn’t pay their fines because they think they are doing the right thing.

The legal changes in the last years

Another threat is to take away child custody. In 2007 there was a major change in the law. Since then not sending your children to school is in itself regarded as a reason to take away child custody. If children are over 16 and refuse to go to school any more, it happens in some cases that they are sent to a psychiatric clinic.

The current situation

When my family started home education was very seldom in the media. Nobody talked about it. But five years ago it started to turn up as a topic in the media more often. The first publications tended to be negative. But this has changed. During the last two or three years there were some good articles in magazines and newspapers and some good documentations in TV. And as the situation at schools is getting worse, it seems to have changed the mind of a lot of people. When I talk to other people about what I am doing, most of the time the reaction is different from what I experienced when we started with home education.

In general the situation has gotten worse during the last two or three years. The different authorities (school authorities, child welfare offices and administration offices) are much more connected now and they are aware that if families are signing their child off from school and don’t give the name of another school, this might indicate the intention to home educate. And often they start to inquire.

For families who like to start with home education quite often now the only way is to emigrate.

Martin Luther king said “I have a dream.”

He dreamed of equality, of justice, of freedom. We have films that are called ‘cry freedom’, I reluctantly admit to balling my eyes out crying when Mel Gibson yelled freedom in Braveheart, it’s some thing that people can almost universally identify with.

Human beings aspire to these high ideals, which take us away from the drudgery of everyday existence, that despite the vagrancies of our fortunes, we can have moments of beauty in living up to these high ideals.

And then we have family. Sharing family live with all its challenges, its ups and downs, exploring ways to live together, get along and get to know each other through out our lives.

And this is the point where we have the dramatic music..the imperial march. In one corner, freedom, equality, family life. And in the other, badder than Darth Vader, more poisonous than a black widow, is something with the potential to beat the good guy, knock Rocky out so that he can’t get back up. That thing is two words, when they are put together are a deadlier combination than the two towers in the lord of the rings..what are those two words……obligatory schooling..

The more dangerous danger, the most horrifying horribleness, is the enemy that you don’t know exists. We are born, and for most of us, our parents never considered the possibility that of an education outside of the public school system. We go to school, meet someone, and think about having children, and again, most of us don’t even imagine that there is another possibility.

But there is a knight in shining armour, perhaps sometimes battered and bruised, but willing to stand up to the heartless villain. It’s two words again, but this time, it’s a beautiful combination: educational freedom.

I believe that there can’t be freedom in a society that has says that those two words, obligatory schooling. There can’t be justice, there can’t be equality. If the state decides that this is the only way, it destroys freedom; family life can be very negatively affected because you wouldn’t be able to do something even though every fibre of your being is telling you that you should do so. Is this acceptable? Do we really want freedom or not? Everyone can have children, everyone could be in a situation where they want to take their children out of school, so this is something that affects everyone, it’s a situation that everyone should join forces and put aside their differences to make sure that there is freedom, whether that freedom is in a free school or being educated with their parents.

Actividad de matemáticas. Empezando a investigar

Actividad para edad de 3 a 5 años

Los niños deben vivir las matemáticas, como algo natural, nuestro deber es acompañarles y ayudarles a descubrir lo que se esconde detrás de las cosas, su significado en la vida real. Los niños pueden aprender a partir de sus propias conjeturas, sus hipótesis y las de sus compañeros que les ayudaran a entender el mundo en el que viven. En la clase se puede trabajar de muchas formas si bien podemos trabajar de forma ostensiva después deberemos ponerlo en práctica, usando el modelo constructivista. El niño aprende viendo, haciendo, hablando, escuchando, tocando, cantando…

Y en cada una de estas formas podemos hacer que desarrolle sin darse cuenta la compleja y maravillosa comprensión y aprendizaje de buenas bases para las matemáticas.

Los niños aprenden matemáticas en su día a día. Y qué mejor que aprender en ese día a día. Si salimos a la calle a dar un paseo, podemos buscar una calle próxima en donde comiencen por la enumeración con el número 1, y hacer que se fijen.

_Mirad esta casa es el número uno, y allí en frente tenemos…

Podemos señalar, y seguro que alguno dirá:

-dos.

Así podemos seguir todo el paseo, y al regreso podemos en asamblea ( o en casa) discutir sobre lo que hemos visto.

- ¿Por qué las casa tienen números?

- ¿Y por qué solo tienen un número?

Plantearemos problemas como ¿os habéis fijado cual es el número de vuestra casa?

Cuando haya quedado claro el porqué a cada casa le corresponde un número, podemos pedir a los niños que cojan sus fichas, pequeña cartulina que llevan al colegio con su identidad y dirección, y con nuestra ayuda podemos averiguar cuál es el número que tienen sus propias casas…

Después podemos hacer un dibujo, cada uno de su casa. Y nosotros podemos tener preparados unas fichitas con los número escritos de las casas de los niños en la mesa de la profesora, ellos con ayuda de su ficha y si son pequeños de 4 ó 5 años, o si no lo necesitan(con 6 años), buscaremos el número de su casa, después lo pegará en el dibujo.

En esta actividad, habríamos trabajado el número ordinal, si fuesen más mayores podríamos hablar de la diferencia entre los números pares e impares, estaremos trabajando como a cada casa le corresponde un número y este tiene una grafía diferente, yvivir que necesitamos de esa diferencia para poder buscar una casa. En otra salida podríamos buscar ya un número determinado. También hemos trabajado la parte artística con el dibujo y colocado el número de su vivienda, con el objetivo de que sigua interiorizando que cada uno tenemos un número diferente según donde este colocado y así poder después en clase (o en casa) trabajar con la cinta numérica.

La cinta numérica es una fila de cartulinas pegadas en un mural, pared o ventana donde los niños pueden constantemente visualizar los números ordinales, es decir: 1,2,3,4,5,6...

Como ellos tienen que aprender que número va detrás de.., les ayuda mucho, ya que en caso de necesidad pueden levantarse y tocando las cartulinas una a una pueden decir uno, dos, tres, este es el 4.

Matar moscas con el rabo

En mi casa decían que "el diablo, cuando no sabe qué hacer, mata moscas con el rabo".
Hace unas semanas se podía leer esto en la prensa:

Mi primera reacción, por supuesto, es la de sentirme identificado con los protagonistas de la historia. No soy toxicómano pero podríamos decir que de alguna manera muchos de los que andamos por aquí probablemente cumplimos los demás requisitos (sin ir más lejos lo relativo a la vacunación, o parto en casa...). Eso sí, sin el componente dramático que rezuma la noticia.

Porque si despojamos del tinte sensacionalista a la noticia (droga, familias excluídas, madres que huyen de los hospitales con su bebé en la maleta y cosas así) ¿qué es lo que tenemos? Pues básicamente una situación que contínuamente se da en la sociedad; niños que se crían con parientes cercanos.

¿Qué es lo que "molesta" tanto en este caso? ¿Que nunca han ido a un hospital? Eso es una suerte... Bueno, en la noticia ya hay carnaza suficiente para tomar partido. Está claro quiénes son los malos y por qué. Pero me atrevo a decir que la exclusión social de la familia no es el motivo. No, lo perseguible, lo verdaderamente malvado de esta familia es que con astucia se saltaron una decisión judicial. Querían burlarse de la justicia, evitar que les separasen de sus hijos. Qué desfachatez...

Así que no nos queda más que aplaudir la intachable intervención de servicios sociales (que por fin han conseguido mandar a esos niños a donde tienen que estar, lejos de la familia). Al menos nos queda el consuelo de que la policía haya encontrado excusas durante 11 años para justificar cómo es posible no encontrar a un niño que vive con su abuelo a la vista de todo el mundo.

Ahora en serio; no conozco la realidad de la historia, lo justificado o no de retirar la custodia... Pero este tipo de noticias, desde mi punto de vista, lo único que sirven es para etiquetar y crear ese clima de persecución tan habitual en los últimos tiempos en el que los buenos son buenos, y los malos educamos en casa, nos indignamos y además con toda seguridad somos vegetarianos.

Hay que cambiar la mentalidad sobre la educación

Sí queremos cambiar la mentalidad, tenemos que luchar desde muchos frentes.

Tenemos que como padres decir basta, poner limites a la sociedad actual. No nos pueden decir como, cuando y donde se deben educar a nuestro hijos. Somos padres responsables y tenemos no el derecho la obligación de hacerlo.

Si la tribu no es buena, los padres tenemos la obligación de cambiar de tribu.

Una tribu más competente, una tribu más consecuente con la realidad que le circunda, una tribu capaz de ver problemas y resolverlos, una tribu con una moral que conlleve el fruto de un nuevo ser humano que tenga los pies en el suelo y la cabeza capacitada para pensar y resolver problemas dentro de los límites de la razón y valores de convivencia, respeto y amor al prójimo. Una mentalidad abierta al mundo, viva y transformadora.

Bajo esta visión he creado un blog donde trabajaré temas de actualidad educativa, haré critica constructiva de todos los temas educativos actuales desde los enfoque educativos, planteare juegos y trabajos para ayudar a los padres. Trabajaré conceptos y vocabularios con los que la nueva educación quiere conducir a los niños (muchas veces sin el consentimiento de los padres).

No todos los padres son maestros o profesionales de la educación, trabajaré competencias y el currículo oficial. Ofreceré herramientas para poder ayudar a todos los padres que decidan cambiar las vidas de sus hijos, dentro o fuera de la escuela.
